Oscar Pistorius: The Sentence

Just smoke and age old generalization. Pity the writer is so committed to fitting people to preconceived boxes, which just amplifies his particular bias. So white Afrikaner men love (and are preoccupied with) guns, fast cars and blond women? That's hardly unique, or necessarily an excess as suggested. Also "love" the statement that somehow rage is part of the Afrikaner's masculinity - not.

It is never a waste of money when justice is sought

OP's legal team even know he got away with it or else they would have appealed but even they know he got off lightly.

OP owes his legal team 10 million, which he does not have, and his uncle does not want to pay.

He probably does not have a legal team at present who are willing to pursue the matter.
Having said that, appeal is made when you disagree with the outcome - he was convicted of Culp, which is in accordance with his story. What should he appeal against? The sentence? It may be slightly heavier than average, but probably not so much that it's disproportional. The judge was pretty thorough during sentencing.

As for wasting public funds, in this case it is just that. We have just been subject to weeks and weeks of unnecessary trial that should have been concluded in 2 weeks, had the NPA properly assessed the evidence. If OP's bill is 17 mil, then the states cost is probably more than double that. My tax and yours had to pay for that. According to our constitution [section 35(3)m] a person should only stand trial once on accusations [simplified], and I am all for that basic human right. While there are those with a morbid fascination with having OP found guilty of murder, the truth is that this ship has in all probability sailed. Like Paul though I would love to read the appeal and its outcome, but that would be for academic exercise. While you might consider it justice to have a perpetrator found guilt and sentenced to your particular brand of justice, I am far more concerned with equity, which includes consistent conduct from the state [NPA] I personally know of hundreds of cases where magistrates and judges erred in explaining their judgements, sometimes grossly, and the NPA did not bother appealing. Like the trial, which was a piece of showmanship from the start, I am afraid that the appeal will follow the same pattern. Should the state through some miracle achieve a trial de nova via its appeal, all this starts from the beginning with the exception that the state will probably end up paying OP's legal representative as he is without work and without income.

I agree with you. But remember op is rich and famous and women love that.

Like I said before do you think he would have had such beautiful women if he was not rich and famous but still no legs?
I doubt it. Women go where the cash and flash is

Apparently she was about to leave him, so maybe she was killed cause she told him it's over? Guess the timing was just a little off, you know with valentines day and what not.

Roux and the dense know that if they appeal, the murder verdict may sit and then they are screwed. Remember he wanted home detention? He knows an appeal will more than likely be worse than what they got because even he knows Masipa gave OP a slap on the wrist.

I also dont believe the fees were so high.
Lets work this out, how many days were they in court in total?
They had senior counsel, junior counsel and what? 2 lawyers, probably one junior and one senior and the blonde for show :D

If OP appeals only the sentence, then only the sentence will be reviewed, not the finding of Culp. So, no, the murder verdict won't sit if OP appeals. Yes the verdict can be worse than he received, which is why it would be a gamble, but then it could also be less.

The cost of the lawyer are reviewable which is what OP's uncle wants to do. Having said that lets look at the states costs which are not reviewable, and are paid regardless. Just consider the obvious costs:
1 Judge
2 Assessors
1 Advocate assisting Judge with record
2 Advocates for the NPA prosecution
Interpreters
Sound (court would pay Sneller for the transcript)
Court Orderly (Policeman)
Additional security guards at court.
Additional security guards protecting the judge.
Between 5 and 15 government officials who daily sat in the trial (including a police general, state pathologist and various other experts) for the prosecution in what could only be described as a show of force.

A bit fresh from Arnold Pistorius to basically question the costs charged by OP's legal team. If the state now goes into appeal route, it will be doubtful that Roux would represent OP (already 10 bar down the drain) and it could possibly get far worse for him. Makes me now also doubt that OP will get out before 10m, considering the friction AP is now causing.

BR got all his money and probably more at that. OP has a lot of money that is stashed away.

Everything you read now is only a game - a game at building protection for OP should Reeva's parents decide to institute civil proceedings for damages. Everything you read in papers will be used in these proceedings to show that OP has no more money, assets.

This game has been played before and will be played many times in future.

All this coming out just before a possible appeal a very sneaky disgusting game indeed

And everyone is becoming an author. June's book to be released. I find this more disgusting than anything when everyone jumps on the band-waggon to cash in. As sad as it must be to have lost a daughter, I would hold my own integrity high enough and not be a sell out for a story and cash and then wrap it under the "I am doing this so that Reeva is remembered" - it's all BS.

Well they need the money or maybe they just want to tell their side of the truth? op told his side which seems like complete and utter bull so who knows why they want to do it

- the actual announcement

Just going by what Mandy Wiener is tweeting.

https://twitter.com/MandyWiener

NPA: Adv Gerrie Nel and Andrea Johnson have been hard at work studying the judgement, researching and also consulting with legal experts.

NPA: Today we announce that the decision to appeal both the conviction and sentence has been taken.

NPA: The appeal on conviction is based on the question of law.

NPA: The merits, demerits of the NPA’s argument in this regard will become evident when we file papers for leave to appeal.

NPA: The prosecutors are now preparing the necessary papers in order to be able to file within the next few days.

To explain the process now - NPA will have to go back to Judge Masipa and ask her for 'leave to appeal' against her judgment and sentence.

Masipa must then decide if another judge could possibly come to a conclusion different to the one that she reached in the case.

If Masipa grants leave then the appeal will be heard. If she turns it down then NPA can petition Supreme Court of Appeal in Bloemfontein.
