Park and sell... please help me

Hi guys

So I got conned and bought a car second hand car that was in an accident for 75k and the car is worth 50k due to condition. I asked the salesmen before the purchase and he lied and said the car is a repossessed car.

I've only had the car for 2 weeks and bought it cash. So upon finding out this crap I did all I could trying to get my refund from the dealership but that was unsuccessful. All I heard was excuses and I need to wait for month end March til he makes a sale.. like wtf.... So I'm in the process and suing these guys as in CPA it states that if a dealership sells second hand vehicle it is their responsibility to disclose any defects with the car to the buyer.

Anyway my question is I'm not getting far with those thieves so I posted an ad gumtree and a company called Brett lee pre owned Randburg contacted me and they do a park and sell and I can get my money back. Has anyone ever used them? Cause I can't afford losing this vehicle too otherwise I'm screwed. Any suggestions?
 
There was a report on carte blanche about a dealership who did this, one day they just disappeared with all the vehicles on the floor. Not to say it will happen with these guys, but do your homework and dont leave any car documents with them. Secondly, you been conned now you trying to make it someone else problem?

What kind of accident was it?
What was the claim amount for you to at least estimate the damage?
What is currently damaged or wrong with the car?
The R50k figure, is it because the car is damaged or is that the actual value of the car? How do you know if the car was not overpriced to start with?
What car is it and What is the mileage?

The car was overpriced. It's a 2013 Honda jazz 1.3 trend. Mileage is 52k. Look the car was fixed from the accident.. but it was badly repaired. I've only had it for two weeks... I spoke to the owner of this park and sell and I checked their website. Yes I am scared to do it cause they could end up stealing the car. They told me to give them R900 to fix the exterior of the car and they can sell it for whatever price I want apparently. Soooo not sure what to do because We Buy Cars offered me 50 but if I take that I lose 25k (that I don't have)

I'm not making it someone else's problem... I don't want this vehicle anymore due to be lied to.. I feel like it endangers my life and my son's life... this car was overpriced and I just want to recover my money I spent on a peace of trash.. I hate this car and want to get rid of it. If someone wants it they can take it. Doesn't mean it's their problem now

So I'm supposed to sit with that car to.avoid making it someone else's problem??. At the end of the day its that person's decision to take the car or not... it doesn't mean I'm passing the problem to someone else... Another man's trash is another man's treasure.. jeez

Still, you have to keep the car if you suing them, if you win the case they will have to take the car back and refund you.
 
Look I'm just asking for help.... a lot of people want this car... I'm just scared of park and sell... although I was told all their cars are insured on the floor, they make their commission through finance and the car could sell fast. I just keep the papers with me and once the sales is done I go and release the papers and get my money basically.

I can't sit with a car while I wait for the lawyer that takes long. What am I supposed to do for transport? This car is losing value the longer it stands here.
 
In a way I hear you. The person who buys from park and sell must do their homework. Only thing is, hopefully P&R should disclose the accident.

I had a long conversation with the park and sell guy... according to him they have accident cars and it gets repaired. People care more about the condition of the car so it needs to look in order... I know my car can sell in less than 3 days if it's fixed properly however I'm vulnerable and I can't loose again. I did my homework and checked, they are a register company, there's not much info on their website, I spoke to the owner and he says they legit so and they sales guys what came were really nice and didn't pressure me... The one guy showed me his ID. So I'm indecisive

I'm pretty sure you're going to have to hold on to the car if you're suing, but check with your lawyer.

You'll also need to be upfront about the vehicle to any potential buyers or you could find yourself on the receiving end of a summons.

In the end it might be cheaper to fix the car and keep it.
 
I have been upfront about the car ever since I found out. And I don't want this car. It just reminds me of the deception. I just wanna start over. Just need advice on what to do. Because I want to do the park and sell but it's the biggest risk that could return all the money I spent. I haven't found any gaps with these guys... I even read the contract

But can someone tell me if it's possible to sell a car without the papers?

No, but if you're the registered owner you can have a duplicate set issued.

Where are the original papers?

Has the car started giving you issues. I don't know maybe I mistaken but 2013 Honda Jazz with 52000km on the clock, selling for R75 000 is not overpriced.

Yes. Remember the car was in an accident a bad accident so the value depreciated. The repairs done were sloppy.. I only found out after when people viewed the car andwhere showed me where the problems lie. It was overpriced due to the damage. Internally it's fine but external wasn't don't neatly...
 
Okay I hear you yeah R25 000 to loss is a lot of money.

Of course it's huge loss. Hence my question is the park and sell cause this company guaranteed to sell it for the original price I paid maybe a little more. It's risky...cause then I could loose the full 75k.. So I'm really really puzzled
