Pupil guns down alleged bully

My thing is, he was 18 in Grade 10, why the hell didn't they boot him out? I am sorry there should be a line drawn on age and school, if he failed again he'd be pushing 21 before leaving school?? Surely they could have just said sorry bud out you go.

if i bully someone i fully intend to deal with the kickbacks. if you push people and take things away that matter to them, they will act out. i don't see what is so redeemable and admirable about being an armchair activist, signing petitions, climbing mountains for cancer, cycling against AIDs, starting facebook groups. these things don't fix anything, everyone sits around and expects someone to come along and fix things for them and has these great ideas which are actually very stupid.

if a good kid was shot, then i'm sorry, but a bully got shot. the bully label should be enough. where was everyone before this bully got shot and why did it get to this point? now we sat around and did nothing and now we want to reprimand the kid for taking actions, be it good or bad, into his own hands

He and his mother should be charged with murder. The End.

We are perpetuating and continuing to feed the problem that we have today that violence sorts violence. That I can only be heard after I've done something violent. Don't cry if you get shot because someone disliked you or a striker burns down your wife or someone they didn't agree with.

It was stated in the articles that were posted that the bully was quite notorious and the school knew and nothing was done. So, in your opinion, what else was the victim supposed to have done?

And if violence doesn't sort out violence in the real world, are you saying that self defence doesn't exist?

no, what you are saying is that a rape victim is raped continually and nothing is done to help her, she should be charged for murder for killing her rapist. maybe the word bully doesn't stick out to you in the way it should, but it's abuse and it's damaging to a person. mayeb you can even blame the bully for making the child psychologically messed up in that way. is murder right? no, it isn't, but is it okay for a person to be abused every single day of his life and for nobody to do anything about it? no, it isn't either.

violence does sort violence. nobody gives a **** about the world until something blows up or someone gets shot. millions of people can click on a petition and send it to the president of Uganda, and he'll just wipe his ass with it, but as soon as you tell him you're coming to blow his brains out **** will get done.

and who gets to decide on misjudgement? i mean where were you when a women is getting raped? and she kills her rapist one day, and all of a sudden you're an expert on what she should have done and what was the best scenario? telling her to suck it up is good practice but it's hard to live with something like that.

i'm not defending the murderer, i'm stating why he did it, and i'm not going to sympathsie with the murdered because if he was a bully, he got what was coming to him. a life is not more important than robbing somebody of their quality of life

This is exactly the problem that was dealt with in bully. More often than not the schools try to ignore the problem, or they simply don't take harsh enough measures against the bully. In two cases the kids felt so helpless they killed themselves. In one of the cases they asked the kids if the bully had changed after their victim committed suicide and guess what the bully had said?

"He got what he deserved."

A lot of the other stories in Bully result in kids resorting to violence or the threat of it to get their tormentors off their back. One girl took her mother's gun onto the bus so that when her bully started harrassing her, all she had to do was pull it out and point it at her. The bully was very sorry after that. The kids that didn't/wouldn't resort to violence either moved towns or moved schools.

At the same time, the bully is sometimes victim of some kind of abuse at home. They have no way of dealing with it so they end up taking it out on other people.

The rest of the time the bully is just a dick who is bigger than everyone and can get away with it.

An East Rand school pupil who shot dead his alleged bully did not plan to kill him, The Star reported on Wednesday.

The paper said the accused's lawyer William Karam told the Palm Ridge Magistrate's Court on Tuesday that the murder was not premeditated.

The now 19-year-old boy shot Nkuleleko Ndlovu, 18, in the head at the Phineas Xulu Secondary School in Vosloorus with his mother's service pistol in November 2012.

The indictment stated that Ndlovu approached the accused with the intention of fighting with him.

The accused shot at Ndlovu after he had slapped him.

Karam's request to the national director of public prosecutions to refer his client to a diversion programme instead of jail was rejected.

"We are not happy about that and [have] appealed against the refusal," Karam was quoted as saying.

"My client was young at the time of the shooting.

"He had been severely bullied and it was not a once-off thing. He had complained to the school but they did nothing and he took the law into his hands."

The boy is out on R1000 bail.

Johannesburg - A judge in the case of a pupil who shot dead a bully in a classroom has questioned why the school never dealt with the bullying.

Judge Bert Bam said one could appreciate the difficult position Tsundzukani Mthombeni found himself in due to being constantly bullied and tormented.

On November 20, Mthombeni stole his police officer mother’s service pistol, took it with him to Phineas Xulu Secondary School, where he was a pupil, and fatally shot Nkululeko Ndlovu,18.

“He (Mthombeni) was apparently unable to defend himself after being subjected to acts of violence and being degraded. Being a bully could have never justified his (Ndlovu’s) death, but one can appreciate that the accused found himself in a very difficult position.

“Why this bullying was never dealt with by the school, or why the accused never told his mother, cannot be explained,” the judge said.

Mthombeni was one of those constantly bullied by Ndlovu and his friends at the high school in Vosloorus, Ekurhuleni.

On November 19, the bullies took his cellphone and school bag.

He was due to write an exam the next day.

The following day, he took his mother’s gun to school.

When Ndlovu and another bully went to his classroom and wanted to fight him, Mthombeni produced the gun.

Ndlovu challenged him, saying he would not be scared off by a toy gun, and Mthombeni fired a warning shot to show them it was real.

The bullies retreated, but Ndlovu approached Mthombeni and slapped him.

In the melee, two shots went off, killing Ndlovu.

The State charged Mthombeni with premeditated murder.

His trial started on Thursday in the high court sitting in Palm Ridge.

The prosecutor was forced to close his case an hour after the trial started, and after calling three out of the 18 witnesses who were in court.

The evidence of the three corroborated Mthombeni’s version of what transpired that day.

Judge Bam found Mthombeni guilty of culpable homicide and illegal possession of a firearm and ammunition.

He said Mthombeni was not a criminal with violent tendencies.

The judge sentenced him to seven years in prison, suspended for five years, on the count of culpable homicide.

On the firearm charge, Mthombeni was sentenced to two years’ imprisonment, also suspended for five years.

Was a victim of violent bullying in school. Although I don't agree with shooting him, I do understand why he did it.

Indeed, even though the criminal record will make life difficult for him. All because he was bullied.
 
Never been bullied at school but I saw a lot of kids suffering from bullying. It destroys kids confidence for life. Better him, than the bullied kid committing suicide. Fair judgement IMO.

Clearly the State prosecutor was a moron. Why the hell did they lay a charge of premeditated murder.

Smacks of the Oscar P trial gimmick.

I've been bullied before and 13 years later I still feel that I need to settle the score. The years of pain that I had to endure is just... It's always there in the back of my mind. I feel no sympathy at all for that muthaf#### that got shot.

Also, going to the principal or the police would only makes things muuuuuuch worse because the police or principal is not always there to protect you.

Agreed. They call it bullying like it is just adolescent kidding around. But in most of these cases it is actually physical and mental torture. They stole his phone, and his books, and tormented him regularly. he knew if he reported it, he would have it even worse.
He didn't have much of a choice. He would oneday have been beaten or stabbed to death. Good on him for sending a future thug and criminal on to retirement. Sorry it ended that way...but understand why it did.
