The Bill allows for "reasonable" cancellation penalties, but does not define what would be considered reasonable, creating yet more uncertainty.
Stupid trend in SA laws. Writing half-arsed vague laws and then we need 2 years, 10 court cases and an amendment to sort out the mess.

Same thing with the licensing issue. Someone makes an unclear policy statement and then we've got confusion & court cases galore.:rolleyes:
 
LOL ... its like my letter from Autopage: You owe us R120 and if you do not pay within 7 days you owe us R5000 for cancellation of contract.

Forget the fact that when they made this demand my contract only had 7 months to go ... its an el-chepo R50 pm special.

This is gonna be a "fun" ride. You dont need a lot of common sense to see that the you know what will hit the fan when this CPB goes through.

It's great for consumers but business are gonna suffer big time. As with a lot of ideas from the goverment and different departments it looks good but they never think it through and take in to consideration what the real world impact will be.

Lets just hope they get all the details sorted out properly before changes are made.
 
Maybe we will be getting service because the cost of non-service will just be too great. And maybe the companies will discover that providing service is actually profitable.

It will only be a cost to those who wanted and got an easy ride in the past.

Most companies will implement an insurance scheme to handle this, much like professional liability. And the cost of this will be passed straight down to the consumer.

Yes, it would be terrible to absorb any of that cost, thus affecting your profiteer margin.

So you're an one-man electrician or plumber. You do some work on someones house and a week later there's some event, the house floods or burns down from an electrical fault or some failure with the geyser.

According to this legislation the plumber or electrician could now be responsible for all costs.

Rather think a bit about what I posted before shooting off prematurely. ;)

I admit there are some electricians and plumbers who are not entirely shall we say "honest" - judging from complaints about AAAA and AAAAA type electricians and plumbers found via the yellow pages. The ones I deal with are pretty straight.

But your company is one that has consistently and unethically milked superprofits from the SA public, with apparent support from government and regulator. So many things you do, and fail to do, betray a greed comparable to that of a velociraptor. Some of these I am happy to enumerate, but not here in this thread. Where your company could have been a massive force for progress in this semi-third-world country, you have rather behaved in the manner of the classic imperialist by raping the meagre wealth of the poor. What were your annual net profits last financial year? And you cannot or will not even man your helpline properly.

I know you are royal game here, and I admit to ( and have admitted on forum to ) an admiration for your personal role here. But please don't "shoot off" about it being unreasonable to expect your company to bear just a lil' bit of pain!

You made a blanket statement about 'profiteering'. And I believe without thinking about it first.

This is not about Vodacom, I'm pointing out that the smaller guys are the ones that will be most affected by this, not the large corporations who have the legal expertise (and financial means) to understand how to handle these requirements.

As I understand, this is a consumer bill. When you need a plumber or electrician you are not a consumer, you are not consuming his service, you are contracting someone to do some work. He may be liable if he uses underspec or wrongly spec'd parts, but surely, even then one will have to demonstrate some connection or causality to the actual damage?
