Vehicle backed out of the driveway and I hit the rear fender. I was on a straight and could not a void the collision. The other drivers insurance denied my claim. Who is has right of wsy

Let your insurance deal with it. But you had right of way.
 
You should never claim on someone else’s insurance, they will take you for a poesss by either prolonging the claim or denying it. You only ever deal with your own insurance then the legal department of your insurance will go after the other party. That is why you pay for insurance.

If you don’t have insurance then you are ferked and haha.
 
As everyone says, your insurance should deal with it. But I get the impression you approached other parties insurance directly? Do you not have insurance? If this is the case, you’ll have to go to court to fight for your claim.

What are the reasons for denying the claim? Do you have a licence? I hope you were not driving recklessly (speeding etc) or under the influence as these could be grounds to reject.

No reckless or negligent driving. Thank you for the advice. I am not claiming from my insurance because I have been claim free forever.
According to the insurance , even if the person who has right of way does not take the necessary precautions ( whatever that means) they are liable for the accident.

That is acutally correct, if you see that you are going to be involved in a accident and you don't try your utmost best to avoid it they can deny the claim, not the first time I have heard of this.

Hint, you should have put in claim with your insurance company, now you pay for your premium and for the repair of your car, not a win win situation.

I think it's crazy that you don't want to go through your insurance.

So the exact reason you need insurance you don't claim? You claim from them, if it was the other parties fault you'll still not get penalized

I hope you only have 3rd party insurance?

That’s literally madness. I’ll provide you insurance too. Cheaper premiums and all. Will be free money since you’ll never claim.

Insurance companies who put up that whole no claim bonuses are scamming people and you’ve fallen for it.

Amazing.
