The DA has called on Tshwane Mayor Nasiphi Moya to “make her position clear” on attempts to remove city manager Johann Mettler as political tensions escalate over his 2022 appointment.
DA Tshwane caucus leader and former mayor Cilliers Brink described Moya’s predicament as “difficult” following Friday’s ANC press conference demanding Mettler’s removal.
The ANC also told the media of plans to call a special council meeting to potentially invalidate Mettler’s appointment.
The ANC briefing followed a leaked letter from Jacob Mamabolo, the Gauteng MEC for Cooperative Governance and Traditional Affairs (Cogta), to Moya, flagging irregularities in appointing senior managers in the metro.
“She finds herself in a difficult position as a junior partner in her own coalition, yet being the mayor,” Brink said on Friday.
“Clearly, ActionSA doesn’t have the power independent of the ANC and the EFF to protect Mettler from being kicked out on political grounds,” he said.
The mayor’s spokesperson, Zintle Mahlati, told News24 that Moya had responded to the Cogta MEC and was awaiting feedback.
The controversy stems from allegations that Mettler’s appointment panel was not properly constituted and has the potential to invalidate Mettler’s appointment in September 2022.
However, Brink denies any potential for irregularity, saying that the panel was constituted correctly and questioned why this had not been flagged in 2022 when Mettler was appointed.
ANC regional spokesperson Bafuze Yebo rejected this, stating that the party had raised these objections before.
“The ANC raised its concerns about the irregularities of the appointment of Johann Mettler as the city manager prior to his appointment being approved by council during the period when it was still an opposition party in council. The matter is not new,” he told News24.
Brink sent a letter to Moya on Thursday, warning against any move to terminate Mettler’s appointment or use a “baseless legal pretext to pressure him to resign”.
“The ANC is the biggest coalition partner in the government of Tshwane,” Brink said, adding that the mayor must, in terms of regulations, bring a report to council if there are accusations against the city manager.
“Various municipalities have been interviewed by similar panels. They’re grasping at straws.”
Brink believes the ANC wants to replace independent professionals with “deployed cadres”.
ActionSA national chairperson Michael Beaumont said in a statement on Friday that the leading coalition, which includes the ANC, EFF, ActionSA and PA, “has mandated Moya to engage with MEC Mamabolo on this matter, with the aim of clarifying the issues”.
“We urge all coalition partners to be guided by this resolution and to refrain from unilateral actions that may jeopardise the hard-won progress of this coalition government,” the statement continued.
Meanwhile, Brink suggested on Friday that the attacks were politically motivated, particularly after Mettler refused to drop the case against the “Rooiwal Five” – the City of Tshwane officials implicated in irregular tender awards to ANC funder and businessman Edwin Sodi.
“The most notable of these attacks happened when it became clear that the City would not drop the case against the Rooiwal Five,” Brink said.
Yebo contends that the DA is attempting to create confusion by conflating the Rooiwal Five with what he terms “the unlawful acts of the DA-led government in the irregular appointment of Mettler as the city manager”.
But the former mayor asserts that if Moya supports Mettler, it could help maintain his position as city manager. “If she were to [take] the right position, I believe the majority of the council can block an attempt to get rid of Mettler on unsubstantiated grounds,” Brink said.
