Counterfeiting may be, but personal copying isn't. Furthermore if the consumer were buying a right to a copy of an intellectual property, then they'd own it for life and could even pass it on to their heirs without it being tied to any particular medium. No more reselling the same thing on different media to the same customer over and over.
