Sleeping at work defense

He can do what he likes during lunch. Boss sounds like a tosser. Let them start disciplinary action against him - he will win. Or just plead ignorance - he was not aware that sleeping during lunch was an offence, and put the ball in his boss' court to prove that it is. He should apologise for misusing company property though...
 
It is during his lunch, so it is his time.
Has he made a habit of this?
First warning is a verbal warning - so there is no reason to go all Disciplinary on him, unless he has done this before...and not during actual lunch - i.e. the defined lunch hours for the company.
If it becomes an issue and it interferes with his normal job duty, then there is a problem.
Does he have health issues? Lack of iron can make you sleepy during the day - he might need to go and see a Doc.
 
As too allotted lunch time, they work on flexi time so 1 hour during the core hours for the most part.
His pants were up :eek: he was sitting in the lid and this is the 1st time he was caught, doubt it ws his first time though

Its easier to get fired for falling asleep than theft, so your bud better start looking for another job.
 
There is nothing they can do, they can maybe give him a warning
It all depends what is in your Code Of Conduct.
Explain that he was tired and that he fell asleep
They might bring in Alcholism or Drug Abuse, but I highly doubt it
Dont make up excuses for what he did.

My father used to tell the story of the Manager going on a tour of inspection with one of the Foremen.

They happened on Bill, fast asleep, in one of the storage areas.

The Foreman made to wake Bill, but the Manager held him back saying, "No. don't wake him, whilst he's sleeping he's got a job."

It depends on Your Job Description
If he is a clerk or something like that it isnt serious.

Yeah, but what if he was hogging the only toilet they had and some poor fellow employee had a terrible case of the squirts and let go in front of the toilet door? :D

Maybe they can charge him with abuse of company property :D

Legally they should have a certain number of toilets per certain number of employees.

So if that's the case then the company is deeper in the **** than they are.
 
Small company as they just went through retrenchments so I'm sure they have less then 15 people.
Job : He is a junior dev :D

Simplist is probably the easiest.

Say he went to the bathroom because wasn't feeling well (severe headache, nausea), he closed his eyes for a few minutes and past out/feel asleep... for the next few days, act a bit off :p
