So i am being sued.

my bike was booked in for a service which should have taken a few hours. After 6 hours i go to the bike shop only to find they are waiting for a part for my bike but i pay them anyway for the service and a few other things they did with it. when said part arrives (they actually sent something on my engine away to have the spark plug thread re-drilled, for whatever reason and i was not informed about this but paid for it anyway). After 8 hours altogether my bike would not start. Get given a loan bike as they say it looks like the valves are messed up by the guy who drilled the thread (he denied it) so the next day i get told its not the valves now (after the boss and mechanic show me that it might be the valves), but its gunk in my engine and they will clean it. at about 3pm i phone them only to be told i must pay them R1480.00 for fixing my bike, i refuse as i did not tell them to do what they did and they went ahead without my permission or even knowing what the cost of it would be. it was a huge shouting match.

the owner of the shop comes to my work today to give me a lawyers letter for the money and calls me a liar.

my bike rode into their shop for a service, for which i paid them, but i could not ride my bike out of the shop afterwards.

i never gave permission for the spark plug thread to be drilled as there was nothing wrong with it and that is not part of the service as far as i know.

my bike is not running better after they had "cleaned the engine out".

now he wants to sue me.
 
As I understand it, they have to inform you of all work that is going to be carried out, prior to them just doing it. I reckon you should seek legal opinion on this Wayne bru ..... don't get bullied into paying.
 
yes i agree lucky for me my eldest daughter works for an attorney and has drafted a letter back to them.
as i think this bike place is a franchise business the "owner" looks like he does not know a thing about bikes and could only go on what his mechanic was telling him and i was right there with them.

Dont buckle for them!

They are trying to bully you into paying. Normally when people get letters from attorneys, they get scared and just pay the amount of money.

Dont! Goto a lawyer and tell him/her the story.

thanks man i am busy with that process, i have so many witnesses on how my bike is not going properly that say i must even take the thing into the small claims court and show judge Judy.
 
No ways man. They don't have a leg to stand on. Ask them to produce the document or evidence where you authorised the "extra work". And then threaten to sue them for failing to carry out the original work and for damaging you bike further. Tell them, that unless they fix this mess you will put their name all over the internet. Anybody who is thinking of using them as a service will read something bad about them. Go on the offensive. Tell them he can call me as your legal counsel and I will explain the law to him. ;)
 
thanks man, you know i could understand that if the work was necessary i was all for booking the bike in for a bigger job when i went on leave and had the money but to just go ahead and do it, that just freaks me out. to tell me the bike packed up on their floor is BS.

Its common knowledge that as soon as business owners cannot get their money they have a letter drafted from the lawyer. 7/10 times it used as a tactic. It seems he is trying to scare you into paying the bill.

I will flip mode on a company who does work on my car without informing me and expects me to pay for it.

Let us know what happens.
 
thanks will do they have given me 14 days to respond but by daughter says the same as you guys, that they are using this tactic to get the money out of me and i did not mention this before but when i argued the money with them they dropped it to R1000.00 then to R600.00, and i have the copies of those receipts, now he wants his R1480.00, well.......

you know i want to do that but am afraid it backfires somehow on me, i actually used them a few times before to service and fix my bike and ask advise, but now after this, i don't know.

I wouldnt go back to them if i was you after this, this just sucks.
If you really want to give them a run, write into BikeSa , giving their details, and explain the con they ran on you, there are many bikers out there who need to be made aware of con artists such as these.

i just sopke to my wife now and we agreed we could give then the money at anytime but its the principal of the matter, you cannot go and do repairs on someones bike and then ask for the money without getting permission first.

i will look into doing what you and the others suggest cause maybe someone else has had a similiar run in.
 
What's the name of the place... I know some bikers who can send the message through the biking community and possibly kill their business...
