SPAM from Vodascum

Sorry to hijack this thread, but I also want to know how to permanently stop this SMS spamming. I have a MyMeg 500 data bundle and keep getting %$**!@# soccer SMSs. Did not subscribe to anything!!

SMS spam from third parties - that is always difficult.

More often than not there is no contact information in the SPAM. When there is a number, it is typically the number for the marketing call center of the spammer. If you phone them, you will either be told that your number will be removed from the list, just to keep you happy, or they will tell you something like: "this is a one time special offer so there is no need to unsubscribe." Either way, you will be spammed again.

You also need to watch out for premium rated numbers. Some scumbags spam you senseless with messages containing these numbers, until you eventually phone them in desperation. That is how they get you.

I have in the past phoned Vocacom, but with limited success. They are obviously not very helpful because the more you get spammed, the more money they make. But a few times I have managed to get the contact details of the spammers out of Vodacom. Phoning the spammers is also the same frustrating exercise: "yes, we will immediately remove your number from that [one particular] list". That is until they create a new list.

The bottom line is, Vodacom could not care less. They can easily implement a "do not spam list" that they enforce on their network, but why would they do that if they can make more money from distributing spam to their customers?

The only solution that I can think of is to find a phone that can automatically delete all SMSs that do not originate from someone in your address book. You will have to add a few special numbers too so that you can get some SMSs, like voice-mail notifications and security messages from your bank. But everything else should just be silently moved to a junc folder and automatically deleted after a few days. If I can find a phone that does that I would be very, very happy.

I think he asked another question as well, one which I would also like the answer to.

1. Why STOP doesn't work.

2. I would also like to know (still unanswered), whether another campaign will require the sending of yet another STOP SMS or whether sending the one STOP will in fact STOP all of them reaching your phone?

If you have 20 companies all with your name and address supplied by Vodacom, you could in theory spend all day 'opting out' of each campaign.

That is not good customer relations at all.

Since Vodacom is the admitted source of your personal details which these spammers use, I believe they have a responsibility to control a master opt-out list.

They could also simplify it by making an opt-in list, with only the details of people who actually want this 'information' sent to them on a regular basis.

There are applications for smartphones that does exactly that...

Err... no. Sending SPAM, is an invasion of privacy. Giving personal contact details to various "WASPs" so that each and every one of them can SPAM you, is an invasion of privacy. Sorry, but you have no idea how lame that excuse sounds.

The real reason is that Vodacom does not WANT to do anything about it, and it is not hard to see why: An SMS is 160 bytes of data. Even if Vodacom charges the bulk spammers as little as 1c per SMS it still works out as R67108 per GB. So it costs Vodacom almost nothing to distribute the SPAM and the money it gets is pure profit!

Other companies obviously have insiders at Vodacom. I was recently called by someone from Cell C who tried to convince me to port. The guy knew exactly how much I was spending on my voice contract over the previous 6 months. Complain to Vodacom and you get the standard response.
 
I have applications that do it i do not send sms`s :D to remove you.

That was his answer, though I'd like to hear more, like what contravention this is. As you said, Vodacom gives out your and my number, so it's the same principle.

Why is it a contravention for Vodacom to control spammer originators and issuing of stop messages, when it is Vodacom themselves who gave out the personal details of their customers in the first place?

While I appreciate your effort to shed some light on this matter, your rather terse answers make it difficult to figure out what you are trying to say.

In response to the question "why STOP messages do not work" you said "There are different WASP that sends these messages". So now we know it is "WASP"s that are sending these SPAM messages on behalf of Vodacom, and if you tell one WASP to STOP, it does not mean that the other WASPs are going to stop. Now I do not know exactly what a WASP is, but from a legal point of view all that matters is whether they are 1) part of Vodacom or 2) separate legal entities from Vodacom.

If these WASPs are part of the same legal entity that is Vodacom, then all WASPs must respect a user's request to stop spamming. Failure to do that would be a violation of section 45(4) of Electronic
Communications and Transactions Act (Act 25 of 2002).

If on the other hand these WASPs are separate legal entities, then it would be a violation for Vodacom to give them the contact details of customers in terms of the privacy laws that you mentioned.

Either way, Vodacom is breaking the law, but please correct me if I am wrong.

Is Vodacom even a member of WASPA. Last time I checked, they were not.
