State capture inquiry begins

DA youth leader had ‘no knowledge’ of his company’s Agrizzi and Mti connections

Democratic Alliance (DA) youth leader Luyolo Mphiti says that while he started a company with former Bosasa COO Angelo Agrizzi’s son Giancarlo, he had no idea it was connected to either Angelo or former national commissioner of correctional services Linda Mti.

At the commission of inquiry into state capture, Mti was accused by Agrizzi of having received bribes from the facilities management company, which is now in liquidation.

At the beginning of the year, the Indlala Group was featured in a report in The Citizen. Giancarlo explained that the business was started following him being “coerced” into establishing it following a meeting with his father and Mti, who said it would provide “consultancy services to various government agencies”.

Kudos to them! I wonder who accepted the award, since it was a large team involved? (The photo seems to show runner up award winners too).

Well done tovour investigative journalists. And of course to Jacob Zuma as well for being the right mix of arrogant, criminal and stupid to let these stories exist.

"From the outset, I wish to make it clear that I deny having been involved in any act of corruption, bribery, fraud or money laundering. I deny that I wrongfully benefitted from state funds as part of an unlawful scheme.
"I had no knowledge of how it came about that details of a personal transaction of mine were on the books of Atlantis Motors."
Munusamy also explained in her affidavit her vehicle was settled by a close family friend, Basheer Ahmed Abdool.

Harrowing stories about how those opposed to State Capture were smeared, sidelined, arrested, victimised, etc. All with the weight and unlimited resources of 'disciplinary inquiries'. See: https://www.dailymaverick.co.za/art...nal-price-for-fighting-against-state-capture/
Over the past weeks, the Zondo Commission of Inquiry into State Capture has heard how at least two ministers of police, various senior SAPS, NPA, crime intelligence and DPCI (Hawks) officials, a private law firm and at least two journalists were used to undermine ethical officials and subvert South Africa’s democracy.

Let said famdamily friend prove that he/she paid for said car with bank statements and all that, and the matter can rest there.

Surely somebody should have some records of using money to pay for a car?

Well the story has shifted slightly now..

Said family wanted to buy a used Nissan Hardbody and paid a deposit, and then when she ran into financial difficulties he reversed the deal with Atlantis Motors but when he tried to get his money back they wouldn't give it to him so instead he got them to transfer it to the finance house to settle her vehicle.

Story has BOLLOCKS written all over it. But assuming its true, did this Abdool feller pay donations tax on that amount?

Good point but isn't donations taxable to donor only if it is above 100K per year (of course he could have made other donations that we don't know of)

And what will it prove if they did/didn't pay donations tax? In any case, tax will be something like 8K+ and I am sure they can manage to pay it now with penalties etc? Assuming that Abdul really paid this, then I reckon this matter will settle down soon.

He paid R143k in one hit to settle her car.

Donations tax on that would be R28600 (give or take) at the time of the transaction... assuming he hasn't paid it, it now amounts to around R92k without any penalties attached.

(143k - 100k) = 43k. With annual exemption, wouldn't it be flat rate of 20% on 43K and not on 143K?

Ahhh damn... overly simplified my life.. yes you are right :)...

Still would probably be nearing R30k he owes SARS at this point, plus penalties..

But yeah, in my opinion (even though I screw basic tax things up), this story is bollocks from top to bottom in terms of her close family member paying this car off for her.

Paying off part of debt is rather common within indian communities. I once paid off one month's rent for someone - they were neighbours but good people whose business went through bad times.

Oh, I'm not questioning that aspect of it... but if you did that to the tune of over R100k in a year (to one specific individual) SARS would have a legitimate claim for donations tax for the amount above R100k and you would be in breach of tax lays if you didn't pay it.

The part I am questioning is the way she is trying to explain away why Atlantis Motors settled the car. I'm sure Atlantis Motors may have something to say about it, or there will be a corresponding R150k deposit from this close family...
