This story seems a bit farfetched especially not wanting dealer to assess it... wonder if its another case of realizing the installment is too much so lets make up something ridiculous

But it's the customers right:The customer is being a douchebag in this instance, she refuses to even give the dealer a chance to fix the problem, they can't be handing out full refunds or brand new replacement cars each time a near new car has a fault, they'll be bankrupt in 6 months.

"In line with the Consumer Protection Act (CPA), the dealer must be afforded an opportunity to investigate whether the defect indeed exists or not. As prescribed in the CPA, if the customer has complained about a defect during the first six months of the sale, then once the dealer has confirmed that there is indeed a defect in the vehicle, only the customer may decide if they want: a repair of the vehicle; replacement of the vehicle; or cancellation of the deal, return of the vehicle and refund of the amounts paid by the customer in relation to the vehicle."
It does say the dealer must at least be afforded an opportunity to investigate, who knows maybe this lady remapped/tuned the car and that stuffed the gearbox system.But it's the customers right:

Surely that isn't worth it. You could buy a used Qashqai for that amount. Tell me you didn't buy that yourself, and it's an insurance claim or something?

Yes the first one did catch fire and they did replace with a new one. But the new one gave a battery fault, which was resolved, but they left the car there
