Tax Admin Penalty issued for 2008?!

I've suddenly had an admin penalty issued for 2008 from SARS. I didn't earn enough to pay tax and I'm pretty sure I don't have any documentation from back then.

I've tried contacting SARS since January but I think they're still on Xmas leave because no one answers emails/calls and they keep cutting my call off before I talk to a human.

Where did this sudden admin penalty come from? What are my options?


I am planning to hire a tax consultant after this is sorted out. I can't stand SARS.

I had to pay R2000 last month coz I never do efiling, ive ignored it for 4 years or so.
I earn waaaaaaaay to little to even have to submit efiling
Which is why I ignore it

Turns out that if you are registered on efiling then you HAVE to submit every year

Anyway, they took over 2 weeks to process the FNB payment that by 1 Feb they hadn't received my money yet so issued me R500 admin penalty

So I paid again over the R500
Let's see how long they take to receive this so that I can be left alone

I'm sure someone on this forum stated that you follow the process on e-filing and provide them that statement of fact.

I think from what I read, they are allowed to track returns for 15 years ( which 2008 falls in ) but for existing filed returns, you are only required to keep docs for 5 years.

So basically they are penalizing those who "should" have filed a return , i.e.: fell within the disclosure threshold at the time but did not.

I think this was challenged in court recently though......
 
Ok admin penalties are levied for something that you should have done but did not. Is there anything in the letter that indicates what is for. Cause if the letter does not state what it is for, how is the consultant going to help you?

You might have to go to SARS and get a human to assist, hopefully a competent one.

This is an incredible business model.

Take over a month to process payments and just keep charging penalties and interest.

Government here in SA is always ahead of the curve.
 
Administrative penalties for late submission

This Tax Alert is a reminder that with effect from 1 December 2022, administrative penalties relating to the late submission of a personal tax return will be charged when one or more tax returns relating to the tax years 2007 and onwards are outstanding.

In previous years a penalty only arose if the taxpayer had two or more tax returns outstanding for these years.

On 17 November 2022, the South African Revenue Service (SARS) issued a Notice stating that they are aware that some taxpayers may have received administrative penalty letters/SMS’s in this regard, in error prior to the 1 December 2022 effective date. The Notice mentioned that SARS is investigating the communication and SARS apologizes for the inconvenience. Although the administrative penalties are allowed in terms of the Tax Administration Act No 28 of 2011 (TAA), SARS concedes that prior to 1 December 2022, the penalties should not have been levied where only one tax return is outstanding. This means that if a taxpayer with an outstanding return submits by 29 November, no administration penalty relating to late submission should have been applied.

An administrative penalty is a penalty levied under section 210 of the TAA. The penalty comprises of a fixed amount penalty based on a taxpayer’s taxable income and can range from R250 to R16,000 a month for each month that the non-compliance continues. This can reoccur up to a maximum of 35 months of non-compliance.

The Penalty Statement of Account (APSA) is no longer sent with the penalty assessment notice and the taxpayer must request the APSA on SARS’ e-Filing.

If the taxpayer does not agree with the penalty imposed, they can Request for Remission (RFR) which is done for all penalties levied for non-compliance. Reasons for non-compliance must be provided. If the RFR is denied, the taxpayer may still follow the objection and appeals processes. A settlement on partial payment may be reached with SARS.

 
So apparently, they can bill you up to a maximum of 35 months penalties from the earliest failure to submit.

Similar thing happened to me. Just paid it (R250 in my case) to get them off my back.
Blow me down, a year later they refunded me with the note "administrative correction - credit".

In my case I need to submit an affidavit stating the company no longer operates and that I do not have any info for 2007
Thanks for the link - there's good advice on there. I'll go to the copshop for an affidavit and then try to make an appointment to see a human. I don't see my boss giving me off work.
I'm pretty sure I wasn't even registered then! afaik I was only registered in 2011.

@Tomtomtom I doublechecked: it's for 2008.
 
As mentioned by the others, check efiling. Also, sometimes when they update their systems, it sends out notifications - i had this a couple years back for 2008, etc as well, and I didnt earn enough back then to submit for taxation. received the AP34 notice on 12/07/2017 and it was then cancelled on 01/08/2017 - their system went faulty and generated notices for past periods.
If its for a period so far back, its most likely an error from their system on their side...they should usually cancel it within 30 days. This is my personal experience on this - started with an SMS, then i logged on to efiling to check and well the call center was not helpful at all.
