My dealings with Telkom!

Hey All!
I'm new to this post so, hello hello.
I just felt I needed to join a community where I'm at liberty to discuss my feelings regarding the broadband issue in South Africa, or should I rather say the Telkom issue. As a student with little money, I actually started a IT business earlier this year, and obviously, the naïve person i was back then, applied for a Telkom line and ADSL 192. Ok, so 3 weeks later I heard that my order was filled in and would be sent through to the order department. Yipee. I nearly croaked when I heard I needed to wait 8 to 12 weeks for my ADSL! But again I accepted their excuses... Ok, so after they installed my ADSL it actually worked! I used it for 3 months and we decided to move to a new place. I immediatly went to Telkom and ordered a move of my whole setup, line, adsl, etc. At first they told me that it wouldn't be a problem. So I was quite happy en pursued the MOVE>>>> 2 weeks after I moved in I went to a Telkom Direct store to find out why they haven't contacted me yet, I mean this is now almost 2 months after I put the order in! Only to be told that someone would contact me soon. 2 weeks later I recieved a call from them, telling me that, get this: Telkom is still designing the infrastructure for adsl in your area and you will only be able to get ADSL end FEB 2007! shocked, I almost burst out in tears. ok, fine, I thought. I'll have to cancel my account with telkom, because I can't wait until Feb!? Now here comes the fun part. Firstly, they wouldn't cancel my account because of an R76.00 arrears. So I payed them and then asked for the cancellation. Telkom reminded me that I signed a 24month contract, as to get a telkom adsl modem for free. This I knew. They told me that I was liable for penalty fees for early cancellation. This I also knew. They told me that the penalties would be R1500! now, this I did not know!

So I made the mistake of signing with Telkom, but never again. From my legal perspective (I'm a 3rd year LL student at tuks) telkom's performance as set out in the contract is to provide me a service. My performance is to pay. ok. Now telkom tells me that they cannot provide the service for me anymore, so, they are in breach of contract? not true? Nonetheless they charge me penalties. As expected they don't want their modem back, but what tickles me is that they charge me R1500 penalties for a modem worth R600 and their the ones in breach.

Anyways, I paid, and thats that. Now I use iburst and not a problem since.

I read all u guys' postings regarding the cases against telkom and I would like to congratulate u all on your hard work.

I really feel that, when we look at the law of competition, there should exist competition in every sphere of business as to create a healthy and strong market. This is not the case with telkom and seeing as the need for communication and the internet increases, telkom only profits more and more.
I think that the best solution would be a second network operator, with it's own infrastructure.

Can I put my hopes on SNO? They are going to use telkom's infrastructure aren't they? Doesn't that make them dependent?

So, I look forward to discussing more telkom issues with u guys and ladies...

Thanks for your story.
Telkom are a bunch of scoundrels. No scruples whatsoever.
As a Law Student I bet you read that contract over and over again to see if you had a way out of paying those fees?

All this shows me is that Telkom know how to draw up contracts.
Service, customer centricity and plain old fairness in business is another matter.
In the short term they will continue to make money like they always have, but there are numerous people who if they could would dump them tomorrow.
Time will tell.

The lesson here for anyone reading this thread.
Never ever sign a contract with Telkom!

I also got internet a while back and I decided to go iBurst. All I can say is no regrets yet! Even with telscums 4mb line I have no intention to look that way.

No, the SNO bought their own infrastructure and are busy expanding it. The only fight is about the last mile. I'm not sure how that will work, but as far as I know telscum and NeoTel must share it. After all, who wants 20+ copper lines running to one house (overseas where there are 20+ operators)?
 
Another thing was, which wasn't clear to me anyway, maybe everyone else understood but I didn't -- this 'firm' involved, the "SA Minority Shareholders' Association" didn't have any assets which is why the judge was wary of it being able to pay for the court costs (for wasting everyone's time for fcking up the formatting rule) and my dad said he kinda reckons that the firm was just established for the purposes of the court case alone and didn't exist outside of it.

Just a quick question. Where do you find out how many assests an association has? Because as far as I know the asso. does have assets. Prehaps you could clarify how you or your "father" came to this assumption. Like... where did you get a list of assets from? or where did you father get the list from? How did you come to the conclusion that the asso. has no assets?

I would really like to know for future reference.

I have always just stood on the lines, reading and enjoying the shows and views put forth by so many subscribers on these forums.

I daresay, i finally created an account for the sole purpose of taking part in this discussion. So, without further delay, my 2cents' worth...:


As far as what the "discrepancies" and "irregularities" voiced from the original post, and hence this topic, i conclude that the judge was upholding his fullest right to reject the affidavit on the grounds that it did not adhere to formatting and layout rules as prescribed by the rules.
Any person who has ever taken part in so much as a bachelor's degree at any university would know the strict repurcussions of overlooking these details.
Personally i remember failing a text i handed in, simply due to the fact that i did not submit it in the correct font, margin, and layouts, as was VERY CLEARLY laid out at the instructions for the report.
I would not expect a court of all places to have any more slack on this matter than the institutions responsible for issuing your priviledge to be in said court.


As for the second major cause of concern, i am backing the position of the original poster completely.
Any judge who clearly, in his own "interpretation", believes that the constitution does not hold grounds for building or presenting a case, should be himself stood to a trial of possible criminal nature.

As one poster noted:
The two judicial systems are not separated from each other, but rather offer interpretations and set the groundwork for each other.

By that reasoning; Are we then not building castles in the sky by throwing out the groundwork?
The very groundwork that was put in place to protect us. The very same constitutional groundwork that is the basis for every law in our republic?

It saddens me to know that the judge in question still precides a chair to this day.


Foul play on Telkom's behalf in this matter? Yes, i do believe they enterred an area worthy of such definition.

Foul play by Telkom in the court, with special regard to the case at hand? No, i do not necessarilly believe so.

Foul play by some seriously deviant members of the judicial system? Absolutely. They always have existed and always will.


Thats my bit in that regard.
