One thing I have learned and perhaps if you had ever been in court you would know, it doesnt matter what the truth is, the defense if they are good will have you in doubt of what you actually saw. Thats a fact.
A good defense advocate will have you screwing up your own testimony, true or not.
So do I believe Dewani is guilty? Yes he is.
These guys could never have dreamed up such an elaborate story

I agree with what you say. You need a solid witness'. But these are few and far between.

I take exception to the use of the word NEVER in the above statement. There are some exceedingly smart criminals out there.

There are too many holes in the guys stories. And the guy that died is the only one that did not take the states leniency offer. But there could be no cross examination.

Quite frankly, I doubt that we will conclusively know what happened that night.

Also reporting on facts in this case has been shocking. EWN felt the need to comment on facial expression , rather than the facts revealed. Rahima essop bah.

Truly speaking, so far the state is failing to prove it's case after much expectation. The judge will have to analyse the testimony and contradictions in Tongo and the other guy's (Qwabe i think) testimonies. If she thinks that the contradictions are not material then she will accept their evidence and find Dewani guilty. But this is unlikely because they are witnessing for the state in exchange for earlier shorter sentences, so their credibility is already in question, and this is made worse by the fact that they are contradicting themselves so much.

I don't know who is still to testify for the state, but if nothing concrete comes up after Tongo then the defence won't even need to offer any defence and they can just move for a dismissal of the charges. The last thing the defence will also want to do is put Dewani on the stand as this can give the state ammunition it needs.

HITMEN PHONE CALLS DON'T ADD UP: LAWYER

Two hitmen apparently knew they had to go ahead with a plan to kill honeymooner Anni Dewani in 2010 without being in contact with her husband, the Western Cape High Court heard on Tuesday.

Francois van Zyl, for Shrien Dewani, showed the court a timeline of the phone calls, as well as audio clips and surveillance footage, to show his client was removed from the plot.

He was cross-examining shuttle taxi driver Zola Tongo, 34, who maintains that he, Dewani, hotel receptionist Monde Mbolombo, Mziwamadoda Qwabe, and Xolile Mngeni conspired to kill Anni on November 13, 2010.

Dewani is on trial for the alleged plot and has pleaded not guilty to charges including kidnapping, murder and defeating the ends of justice.

The footage and audio clips were taken from that night at the Protea Hotel in Century City, where Mbolombo worked.

He was seen at the front desk phoning Tongo at 6.35pm on the night of the murder.

Van Zyl said phone records showed there was no contact between the men after that, between 6.38pm and 9.33pm.

In that time period, Mbolombo phoned Qwabe at 9.31pm and they spoke in Xhosa for 126 seconds.

A translation agreed upon by both the State and defence showed the receptionist was telling Qwabe: "You know that thing we were talking about. It must happen today."

Van Zyl said this was strange because Tongo had told the court that Dewani told him at the Surfside restaurant in Strand that the plan should still go ahead.

"Would you agree with me that if Mr Monde was referring to the hijack, he could not have obtained that information from you at 9.31pm? Would you agree with that?" Van Zyl asked.

Tongo said he would not be able to testify about a conversation that did not directly involve him and did not know what the men were speaking about.

"I am putting it to you that Mr Mbolombo had a much bigger role in the events that occurred than what you want to imply," Van Zyl replied.

Dewani claims the couple were hijacked as Tongo was driving them through Gugulethu in his minibus on Saturday, November 13. He was released unharmed and Anni driven away. She was found shot dead in the abandoned minibus in Khayelitsha the next morning.

The State alleges he conspired with others to stage the hijacking in return for R15,000.

Tongo is serving an 18-year jail term. Mbolombo was granted immunity from prosecution in exchange for testifying against his accomplices. Mngeni was serving life in jail for firing the shot that killed Anni, but died in prison from a brain tumour on October 18. Qwabe is serving a 25-year jail term.

In one of the audio clips played in court on Tuesday, Mbolombo is heard telling Tongo there were "five of us".

Tongo told the court this number included Dewani, but Van Zyl said this did not make sense.

DEWANI GAVE MANY THANK-YOU CARDS

British businessman Shrien Dewani gave many thank you cards after the death of his wife Anni in 2010, including to his hired shuttle taxi driver, his lawyer told the Western Cape High Court on Wednesday.

Francois van Zyl said the Cape Grace Hotel in Cape Town organised a lift for his client to a shopping mall at the V&A Waterfront to avoid media attention. He bought 10 hand-made cards of African design, which he put into a plastic bag.

Dewani gave one of these cards and R1000 to driver Zola Tongo the same day, on November 16, 2010, and thanked him. A few other people also received a card.

"Sir, whether they sent a card to the minister or one to the president, it doesn't concern me. He never gave me a card," Tongo told Van Zyl during cross-examination.

Tongo, 34, who is the State's 12th witness, said he only got R1000 out of a promised R5000 commission for his role in Anni's murder.

He is serving an 18-year jail term as part of a plea bargain.

Van Zyl was trying to show that Dewani was not part of the plot, and that surveillance footage of him and Tongo at the hotel on November 16 was an innocent exchange rather than Tongo's commission being paid over.

Van Zyl said Dewani gave a thank you card and R500 to the police captain who helped his family and drove them to see Anni's body at the morgue.

A certain Patel family received a thank you card without money for their support.

"A considerable sum was also paid to the staff of the Cape Grace who assisted him in this period, to be specific it was R15,000," Van Zyl said.

Deputy Judge President Jeanette Traverso joked with the Xhosa interpreter that she hoped she was not going to go and work at the Cape Grace Hotel, causing the court room to erupt in laughter.

Tonga chirped in: "It surprises me that he gave such a considerable amount to people but he could not pay me," which even caused Traverso to smile a little.

The court was shown footage of Tongo walking out of the hotel with a plastic bag in his hand. Dewani had given it to him in the hotel's communications room.

A close-up was shown of the bag and Van Zyl asked the court to be aware that there seemed to be something inside. Tongo denied the bag had anything it.

He has been on the stand for a week and appeared irritable. Traverso said she noticed he was getting very angry and asked him to try to remain calm and answer as best he could.

"I know Mr Van Zyl must be irritating you," she said.

Apparently the defense has a witness that will confirm Tonga is lying. That is going to make Tonga very nervous.

Marine1 is right, a good defense can definitely break you.

I am waiting to hear if any of his other clients have been hijacked
