TIGHT SECURITY FOR MALEMA TRIAL

Security would be tight at the Polokwane High Court for EFF leader Julius Malema's trial Limpopo police said on Sunday.

"Members of the SAPS will be monitoring and patrolling the area in and around the court, as well as the city centre and identified areas in Seshego with the aim to ensure peace and stability," said Brigadier Hangwani Mulaudzi.

"No lawlessness will be tolerated and those who break the law will be arrested immediately."

Security would also be tight at the Nirvana community hall on Monday from 6pm, where members of the Economic Freedom Fighters would be holding a night vigil ahead of Malema's trial.

The same applied for the expected motorcade and march into the city centre on Tuesday morning, when the trial is scheduled to begin.

"Members of the public are cautioned to take note that the streets around the Polokwane Court will be closed for traffic from 6am on Tuesday morning," Mulaudzi said.

This included Schoeman Street from Thabo Mbeki to Bodenstein Street, Landdros Mare Street from Thabo Mbeki to Bodenstein Street, and Hans van Rensburg Street from Thabo Mbeki to Bodenstein Street.

"The mentioned streets will be permanently closed from Tuesday and motorists are advised to avoid the area around the Polokwane High Court," he said.

"There will also be disruptions in the traffic flow on Tuesday morning from Nelson Mandela Avenue down to Marshall Street to the court, where a supporters march is scheduled to take place."

Mulaudzi said only a limited number of people would be allowed into the court room, with police and private security to enforce tight control at the court.

Malema faces charges of fraud, corruption, money-laundering, and racketeering, with his trial expected to be heard from Tuesday to October 31.

It was alleged that Malema made nearly R4 million from corrupt activities. He is out on R10,000 bail.

On August 25, Malema said he was confident of beating the charges against him.

"I do not fear anything, because I know I've not done anything wrong," he said.

No bets from me too :) May take on this is that the courts will play safe - they will want to see what comes from the Zuma spy tapes saga - especially now that Sunday went alll out yesterday - obviously that Malema will come out with all guns blazing, saying you must clean from the top down.
 
The most ridiculous court case the civilised world has ever seen. Since when do we charge shareholders for the actions of directors?

That is not how the legal system works.
 
So the trial is about to start in 5 minutes. One thing to mention though, the NPA head still had to make a decision on whether to drop the charges (ala Zuma case) or continue with the trial. I think it's in his best interest to drop it, coz I don't see Malema losing this case if he can afford to pay Laurence's millions in legal fees. Unlike with Oscar, Julius doesn't have a rich uncle and he has to pay SARS R500k a month so there's no way he'll afford a protracted trial. As far as the merits are concerned this case is very weak.
 
So the case is postponed, what a waste of everybody's time. The state is not going to win this case, so why waste our time.

The problem is that the loss of the DSO aka scorpions has resulted in the country losing it's ability to successfully investigate and prosecute sophisticated crimes. At the same time, government and private sector corruption has gotten more sophisticated while the investigation capabilities of the state have regressed a few fold.

Just because its postponed you assume the state will lose?

You can't prosecute a shareholder who is not a director of a company for the actions of the directors. All you can do is reclaim the proceeds from such shareholding if deemed to have been received improperly. If it was possible then many shareholders will be prosecuted for the failure of Fidentia, Enron, and many companies which run pyramid schemes. If Juju is jailed, then it will be precedence setting, because no court in this country has ever convicted a shareholder on similar charges.

What the postponements tells us is that the state is on a fishing expedition, and the NPA boss is delaying dropping the charges until his commission of enquiry.

it's not as simple as prosecuting a share holder - as per fidentia etc.
the allegation is that he benefitted (an an "indirect share holder) from tender payments during his time with ancyl.

Sad how politicians get away with a lot, won't be surprised if Malema gets nothing on him.

All shareholders of companies who have government tenders benefit from tender payments and we don't prosecute them because that its not a criminal offence. It can't be suggested that he was involved in corruption since he was not involved in both the company or the government which issued the tender. So this is very ridiculous.

And rightly so I argue. SARS was right to claim its tax from the benefit, but its ridiculous to charge him with racketeering.
