The Nicholas Ninow Rape Case and Trial

The state didn't even verify with the victims after he plead guilty if they wanted to have a trial. They just said let's do this. It should be up to the VICTIMS not the PUBLIC if they want to be dragged through a trial if he already plead guilty and his sentence will be the same.
If the victims didn't want to have a trial, then they shouldn't have laid a charge with the police. It isn't up to the victims( or their lawyers )to determine how a criminal trial should proceed.

No black twitter is saying it's mitigating circumstances. It's up to him to prove any mitigating circumstances or his lawyer to bring in witnesses to claim that drugs caused him to rape. He is not doing that. They are not calling any witnesses. He just plead guilty. His sentence will be the same if he plead innocent.

If the evidence is overwhelming as was this case then it is irrelevant to the sentencing if he plead guilty or not.

There will still be aggravating and mitigating circumstances presented before sentencing. And then I will revisit this thread once uses the guilty plea as a mitigating circumstance.

There is no need for a trial or to decide how it proceeds if he has plead guilty. If they are not satisifed with what he said then they must be specific and give him opportunity to in front of camera and writing provide details. You can't act as if he plead not guilty and go through irrelvant processes like the waitress IDing him. he plead guilty!

yes there have been cases it has been as it means the person takes responsibility for their crimes and doesn't play dice of getting off on a technicality. However it is NOT always the case like social media is pushing with this case. The evidence is overwhelming in his case. He pleads guilty because he can't worm his way out of it.

After this case the EFF started calling members of the DA rapists and Nicolas Ninow in pariliament.

Malema, who called Steenhuisen a "racist young white man who was accused of rape".

BLF recognizes that this is not an isolated event, that the assault on the 6 year-old black child by the racist peadophile Nicholas Ninow, who allegedly confessed to have done it before, is not an enigma. He is a true reflection of all white males. A species that is dangerous, enabled and racist. You are defending him. For some reason you want him spared the disgust of public glare. He deserves everything coming to him.

What's waiting for him in prison is much, much worse than public glare. For a crime such as this, there will be no sympathy from warders or inmates.

Ninow's lawyer mentioned drugs and mental illness in the early hearings. Based on this, the prosecution asked that he be sent for evaluation to take away the possibility of him using any sort of defence that implies that he is unfit to stand trial or cannot be held accountable for his actions which would lead to a lesser sentence.

They're too eager to be racist so they can't even begin to comprehend that the prosecution is trying to ensure that they can get the maximum sentence by taking away one of his best possible defences.

When political parties start making statements and generalizing whites are all like that then you tread on very dangerous ground.

In his guilty plea:
he detailed her rape in detail and also saying he raped her twice
he said he knew what he was doing was wrong but still did it
he said he tried destroying evidence.

Because in his guilty plea he said he was aware what he was doing was wrong and in doing so he eliminated any defense including the drunk and drugs defense as substances would make you not think of that. It's a pretty open and shut verdict with no mitigating circumstances because his guilty plea was so detailed and included his state of mind.

Nicholas Ninow changed tables at the Dros restaurant where he raped a seven-year-old child so that he could be closer to the children's area.
This was part of the testimony of an employee at the Silverton, Pretoria, restaurant on Monday. The employee asked not to be named.
Ninow is accused of raping a seven-year-old girl at the restaurant in September 2018.
Earlier on Monday, Ninow pleaded guilty to rape, possession of drugs and defeating the ends of justice in the Pretoria high court. He pleaded not guilty to an assault charge.

I think it's been pointed out that the state might disagree with his claimed spontaneity of the events that led up to the rape.

Thus they are fully entitled to continue with the trial.

It's not the first time this has happened.
In that case have witnesses that can attest to that. Not every witness that will simply confirm his guilt again.

The problem isn't the law. Child rape is a life sentence.

The problem is the parole board, which simply doesn't do its job in determining who is a threat to society and who isn't.

Yet it will routinely be taken into account especially with a guilty plea. Victims will regularly be consulted on whether or not a plea bargain is acceptable.

If it's indeterminate then by definition it's not life. The problem here is not the parole board which is expected to grant parole because of our overfull prisons but the law which allows parole. Unlike in other countries where life actually means life.

Only a few countries have life without the possibility of parole. Most set life as number of years served.
