You can't just unilaterally withdraw from a contract for whatever reason and then sign for a competitor, you sign a contract when you enter the auction.
He would definitely be losing that court case if SA20 decided to take him to court.
Which has now set a very bad precedent.

The fact that they lost the case, have to pay his legal costs AND chose not to sue puts them in the wrong.
Breach of contract is therefore irrelevant.

Two different entities . The case before the court was CSA vs Shamsi regarding Noc's.

SA20 is a different legal entity and would have been a different legal case.

The NOC case was about not granting him a certificate for the length he wanted for the ilt20.
The breaking of the SA20 contract wasn't part of the legal case. It was whether CSA should have the power to deny a player the right to go and play in a league or the length. The court sided on the worker side.

As a non contracted player CSA has no legal grounds to sue him. It's like they're blocking him from resigning to pursue a better paying job.
This being AFTER they already secured a replacement player.

They are very good. Lad smacking us for 127 made his IPL debut at 16.

This isn't a vintage SA team either. Maybe we should have picked Kwena and lhuandre, technically they are still eligible.
