New company could still retrench you in month 1 (without having to pay a cent more than that month's salary), so it really doesn't make that much of a difference.

The OP also lost his long time G/F over a misunderstanding around this as well. Think that this horse has been properly flogged now, and this thread should be closed really. I don't think he needs a daily reminder.
 
Go back to the company which you left, they know you better than any employer there.

If you aren't as retarded as you sound by resigning without a signed offer, hopefully you did not burn any bridges and left on good terms.

Resigned without having a concrete (signed on paper) place to go. He probably streaked naked and pissed on the bosses car.

Only after going through the correct process, otherwise they end up at the CCMA.

OP, I think you are you are treating your job hunt like online marketing (posting a classified and waiting for a response) instead of direct marketing. You should identify places where you want to work and contact the marketing director, whether by phone or by phoney appointment and then sell yourself like you would sell a product.

I've made some mistakes in my life and I take full responsibility for my actions.
I lost my girlfriend, a great family a great job and security due to me being a selfish awful human.
I left everything because I thought that I would be happy in JHB and have a good life.
i was wrong. i wrote a letter to my ex (5 pages long) explaining everything ive been going though and why i did what I did, I never begged to have her back but I had to put my pride aside and explain my selfish ways. I also contacted her parents and thanked them for all they did for me.

I am done beating myself up. i have made mistakes for many many years. and now I am unemployed and I am consoling my disappointment on this forum.

Thank you for people who are giving me tips.

I am great and marketing, strategy, branding and market research. I am pumping my CV out but I think I should just pick myself up and start my own business. and thats what i am going to do come hell or high water.
 
Really i am just some random on the internet. but thank you for all the advice.

This morning I woke up feeling hopeless questioning why I am not hearing from anyone that i sent my CV, because I am damn good at what i do. But had a pep talk from a good friend. and also positive feedback from most of you guys.

So thank you all.

Good outlook to have. Sh it Happens Bro. Its always darkest just before the dawn. One door opens as one prepares to open yada yada. But you dont need pep talks. Just stick to your guns. Dont give up. It WILL get better.
 
Incorrect - with a probation period, the company can give you 24Hrs notice.

Not if they are calling it a Retrenchment. That has a process that must be followed. You are correct if dismissed under terms of the contract, but Retrench was the word used.

Then they're shooting themselves in the foot. Retrenchment means the position is no longer needed, i.e RH can take them to the CCMA if they appoint somebody else after retrenching him and can then claim up to a year's salary...by law.

Retrenchments may not be used as a disguise to effect dismissals based on misconduct or incapacity, although it is a fact that this practice is quite widespread.


This conclusion I reach based on the number of enquiries I receive from employers who inform me that they have perhaps a hundred or more employees but "we need to retrench one employee" Nobody "needs to retrench one employee " and it is blatantly obvious that the employer is disguising a dismissal as a retrenchment. This is a despicable and disgusting practice – not to mention that it is totally unfair procedurally and substantively.
