Hello,

I have a problem with a vehicle repair that is going south and I need advice for when it does.

Just to give you some background info. I have a Nissan Murano with a CVT transmission that started giving problems. Apparently the problem is very rare and so Nissan quoted me on a new transmission, which came to a total of R62K. My extended mechanical warranty will only pay R20K, so that still left me with R42K.

Not having that kind of cash laying around, I decided to source a used transmission. But there seems to be an oil pressure problem with the transmission. I am busy pressuring the people who sold me the transmission, but they don’t believe Nissan and they have their own ideas as to what the problem might be.

People mentioned to me the Consumer Protection Act. But how would I go about enforcing that should I need to?

Also, can I not somehow claim something like this from my insurance company?

I still owe about trade-in on the vehicle, so I suppose selling it is not an option?

Please help, any advice will be appreciated.

Thanks

A rock and a hard place comes to mind. :(

No, you cannot claim from insurance - that gearbox should never have been offered to you as a used item.

When buying, what is basically scrap, you are not going to be covered by CPA either, as I'm pretty sure the "supplier" will have covered his backside in that respect - a used gearbox is very different from a used car.

Yes, you cannot trade the car in with a buggered gearbox, either.

Sadly the CVT on the Murano was Generation 1 and an absolute dog. :(

Ok, thank you for the advice. I forgot to mention that the place who sold me the transmission gave a 1 month start-up warranty.

I just spoke to the mechanic from Nissan. Apparently this guy asked that Nissan check a few other things as well, but they don't want to play along anymore. They are going to ask this guy to collect the transmission and fix it.

Good luck man... Did a gearbox on my Murano last year and had a few other issues too... Took 11 months to have it fully sorted out as well as a lot of $$

11 months :wtf: ...I'm at 2 months, 8 days :(

Nissan also informed me now that seeing as it is not their problem anymore, they are collecting the courtesy vehicle tomorrow.

At least we carpool to work, but this is still going to make my life quite difficult.

Why not get a 2nd opinion

I believe Mayfair Gearbox is the Authorized repair agent for Nissan

Actually, the Nissan dealership (Bethlehem, Free State) stopped using Mayfair Gearbox because there were too many comebacks. They now use RDG (Rex Diff and Gearbox) in Boksburg to make the repairs.

So the other problem is that my vehicle with the transmission is a few hours from Johannesburg.

I'm going to push these guys to get everything fixed at their own expense. Having Nissan take the transmission out and put it back in again is VERY expensive.

I see, that's quite a dilemma you face, it also highlights a sad fact of many dealerships being "Parts Fitters"

Are RDX geared up to repair the Murano's CVT?

To be honest, I don't know. They had my original transmission with them diagnosed the problem as a faulty bearing. But they said it cannot be replaced and advised Nissan that I need a new transmission.

The guys from OBT Fleet Maintenance asked that the vehicle be sent to them now. But they want me to organize the transport.

Having a flatbed truck take the vehicle from Bethlehem, Free State to Alberton won't be cheap. Any ideas?

Honestly, I would have been better off scrapping the car... But now it's sorted and works 100%, spent way too much though

Up until now I only paid courier fees for a pipe. So I pray that it will not come to that.
