To my surprise there is no vlive.co.za webby up and running

vlive.co.za gives.....

Doesn't quite work that way anymore with registering domain names :)

In my personal capacity, I actually had to hand over a domain I registered a long time ago (but never used) to a company that could show it was close to an active commercial entity. Legal advise was not to try and fight it.

So the days of registering a "macdonalds.co.za" - type of domain and waiting for it to be bought seems to be over....

So is the resolution process actually functioning now? Thought it was still being formulated by the DOC. (For .za domains I mean)

If the domain was registered before the company was founded there is no problem. It is only an issue if I register, NoCap as a company, and someone else gets NoCap.co.za afterwards.
 
I think even in that situation if you aren't using the domain and don't have a business or other entity by the same/similar name you could be required to give it up.

There's also the issue of 'passing off' where you register a domain and attempt to use the association to pick up business. For example, in this case, you register 'vlive.co.za' and use it sell similar products to the Vodacom VLive site.

Legally, it can then be argued you are using the Vodacom association and marketing efforts to pick up business, i.e. you're 'passing off' your business as Vodacom.

So to retain a domain name, you have to have strong supporting evidence that it is directly tied to your active business.
 
If you take a look at the registration date on that domain you will notice that it was a little longer than 2 months ago. That being said, I think that my assumption is correct and this guy registered the domain with the sole purpose of selling it back to vodacom.
 
On one hand i just cannot understand why voda aint got this, but on the other hand, and as Vg has explained - its vodas domain whether they register it or not... lol.

They guys probably just missed it when registering potential URL's or maybe decided not to. Will ask them.

Definitely easier to register upfront than fight about it later on......
 
Well, what if i registered it, not saying i did, but what if, and i was using it for something totally unrelated to vodacom or vlive, would i stil be at risk of loosing it?
 
I think if you had a clear business case for using it and you weren't profiting off the Vlive/Vodacom brand you'd probably be ok.

I'm not sure exactly what they need to do to take it, but they will have to prove that you registered the domain to sell it back to them for profit. So if you use the domain for whatever purpose that hasn't got anything to do with them or isn't related to their products etc, I don't think they could take it away as easily. But why would you want to use a domain name such as vlive for something that hasn't got anything to do with vlive? That makes as much sense as to use the domain shoes.co.za to sell computers.

same principle as registering gooogle.com or yahooo.com, the spelling mistakes ppl make, could get you some "free" traffic.
The vlive address is live.vodafone.com if i am not mistaken, but what address would you try if you did not know the correct address? first comes to mind is www.vlive.co.za
