Hey guys

So a family member upgraded in november/december to a BB torch 9810 and received the new phone

Now about a month back the speaker gave up so was sent in for repairs.

Vodacom called to collect the phone on friday and the phone given back was a refurbished model

Now the thing is we paying for a new phone, what can be done to make sure we get a new phone or the older one back which could be fixed
 
This is normal procedure...specially when it comes to Blackberries. Instead of fixing ure old unit, they will exhange it with a refurb unit. 99.9% of the time the refurb unit is in much better condition than the clients old one.

Same thing happened to me a long time ago with a Nokia E51. The keyboard stopped working, it was sent to Nokia eventually by a shop in Menlyn (not the VDC repair centre) and Nokia offered a new/refurb unit. I accepted and now mom has the unit. Turns out the replaced phone was a new unit - but then nokia in my experience has always been second to none when it came to these kind of issues.

Is it possible to ask the consumer first if he/she would like a refurb unit or fixing his purchased unit prior to acting with no concent? Perhaps offering an option to the customer would be a better way to go irrispective the make/model of phone

In terms of the CPA, it's the consumer's right to request for repair, replacement or refund if there is a fault within 6 months of purchase.

Well technically, when your "new" unit is returned, it will also be "refurbished"...

technically correct...but how old this unit is and what has been wrong with this unit is a good question

The amount of time left on the original phone will be moved over to the IMEI of the replacement, thus your warranty will remain in place and unaffected. If it gives problems...then you take it back for repair. Unfortunately, from my perspective, Blackberry is a brand that loves going to Vodacare.

whats the best we can do ockie ...

and a phone thats 2 months old gets messed is not fair

Pity Vodacom don't abide by the law in this respect. Is this standard business practice across all networks, to ignore the 3R pivots of the CPA regulations?

You now have the swop unit...I suggest they use it. It is covered by the warranty that was left on the 1st unit. Other than that, I dont have any further advice. As mentioned...this is standard procedure for Blackberry repairs especially.

U can take it up with the Vodacare..but I would say no. The unit have been repaired as per the warranty policy and you have been issued with a working unit with no physical damage and the warranty carried over to the new unit. If the unit failed withing 7 days of invoice to you, then the OBF claim could have been done and a new unit issued...but the 7 days have come and gone in your case.
