Who pays when their dog attacks?

Sorry to hear.

Get yourself a polar bear. Walk past house again, let polar bear climb over wall and F-up everything, then claim she poked the bear.

You don't carry a weapon with you when you walk around? It's this lady's fault, but I would get something to at least defend myself with if I were you. We also walk our dogs daily, and they're very well socialized, but we have had instances where other people's dogs would escape the yard. No damage to date, luckily, but there are two yards I am a bit concerned about.
 
I took a picture of the house, but you cannot see the dog behind the gate unless you go up close, when it pushes aside the shade cloth and jumps up and have emailed it to Law Enforcement, suggesting that they failed to do their job properly. As you walk up to the house, there is a lot of barking. I think they went to the wrong house

Nah. Law enforcement are useless. I had the same with s barking complaint. First there was no dog. Then there was, but it didn't bark. Finally they accepted the complaint when I provided recordings of them on the phone with the dog barking in the background, and I made sure they were on the phone fo about three minutes. (took a complaint to the city to the city ombudsman with attached recordings to finally get resolved)
 
Don't have any advice to give. But thanks for sharing your story. I go jogging with my mutt a few times a week in residential areas and I haven't really thought about this possibility. Gonna look into taking pepper spray or something with.

Maybe if you had initially told the police she deliberately opened the gate to set the dog on you and then opened a case of assault, then maybe they'd have given it more serious attention.

Nope they wouldn’t... police honestly don’t like getting involved in these sorts of things

very sad when you have to lie to get the police to take you seriously. Sadder still, when they still couldn't be bothered. :crylaugh:

Pepper spray has been unreliable in my experience. A living thing on adrenaline won't always stop, and don't always feel the pain.
 
Law enforcement were told to go to Lady Anne Avenue in Newlands. They went instead to Lady Anne Walk in Brooklyn (near Ysterplaat) as their GPS said there is no Lady Anne Avenue in Newlands

They have heard of Finsbury Road though. If you go to the end of Finsbury, it becomes Lady Anne Ave.

There are now more important priorities for them so I will have to wait

If it works on bears it will work on dogs, I have seen footage of dogs that were pepper sprayed by housebreakers and you can see they feel the burn as much as humans, if you do it early enough the dog will rethink his plan, its definitely better than nothing.
 
The reality is that you probably won't see a penny.

Didn't work on any of the three dog attacks I've been involved in. One ended up with my mother getting stitches. I don't trust pepper spray (not for dog) and never replaced the bottles I emptied back then.
 
Chrisg, don't give up on this, despite the inconvenience to you of getting action from law enforcement. You owe it to yourself and your dog, but also to your community. Next time it could be a small child, and things could end up very differently. Many people don't take the importance of dog training seriously, either for their dogs or themselves.

Maybe get better pepper spray, also make sure it's the stream spray type not mist and make sure it's in their eyes/up the nose, if you dose them properly and the dog is still in exploration mode there is no way they will not stand down after you do that.

Don't wait for the situation to escalate before you use it, once certain dogs are locked into attack mode they are neigh impossible to control unless you have a baseball bat at the ready.

Granted just as with humans some individual dogs or breeds probably have a mindset thats more amenable to allowing them to block out the pain but that doesn't discount usefulness of pepper spray.

The law is very clear and amply established in precedent: Masters are liable for the delicts of their animals. Period.

To succeed in an action, you will of course have to make more than an allegation. You will inter alia need to prove that the animal caused damage/injury, that the person you are suing is the owner of the animal, amd that their action was negligent / wrongful.

If you suffered personal injury, your legal action is an Acto Iniuriarum. If you suffered patrimonial loss, it's an Aquilian action.

Pepper spray was fine. Trust me (I tested it). Was also the stream (best ones, IMO). Problem is though that you can just go around spraying non-aggressive things with pepper spray. When you need to spray the dog, in other words, when he's attacking, that's too late. IMO an attacking dog is the same as an attacking person, and I'll treat them the same.
