Who pays when their dog attacks?

Pepper spray was fine. Trust me (I tested it). Was also the stream (best ones, IMO). Problem is though that you can just go around spraying non-aggressive things with pepper spray. When you need to spray the dog, in other words, when he's attacking, that's too late. IMO an attacking dog is the same as an attacking person, and I'll treat them the same.

If a dog is off the leash/not under the owners control and is running at me/my dog, has even the slightest aggression and does not stop when I command him to then the dog gets the pepper spray.

The point you make is very valid because once the attack has started its too late, even smaller fighting breeds are very difficult to fend off once they have decided to attack and trying to control 2 dogs in a ball of fury racing around in circles is neigh impossible. I also have a small dog so the fight is only going to end one way if one starts with a bigger dog so I err on the side of caution.

Essentially the owner deserves the pepper spray for not looking out for their dog but if push comes to shove I'm taking no chances, menacing dog on the loose, away from the owner and not responding to my command - pepper spray. I also take evasive action and make a large detour around such dogs so there is no ambiguity whether the menacing dog is making a beeline for my dog or not.
 
You could also pepper spray her dog everyday you walk past her house, it won't come near the gate again. Teach the B!tch a lesson

This is really bad advice.

The owner should be punished, not the dog. Spraying the dog a week later with pepper spray will not teach it anything as it won't relate the punishment to the offence.

This would just be animal cruelty and if your caught it would likely have a negative impact on your case / claim.

100%, the owners are the ones that deserve the pepper spray, I'd only use it on a dog as a last resort to prevent being attacked but even then I would much rather use it on the owner..

Rather leave a dozen eggs in the sun for a week and throw them over the wall, the smell is insanely bad, do that regularly.
 
I'd rather develop a plan to engage the owners in a friendly and non-confrontational way, and ask them politely to make good your loss. Give them a full breakdown of all costs. In writing.

If they rebuff your advances, simply sue them.

No need to get all aggressive or resort to pepper sprays, rotten eggs, or other anti-social acts. There are civilised remedies. Don't let the juvenile behaviour of others pull you down. Etc.

OP did say the bat two up the letter he handed her without opening it. Doesn't sound like person you can rationally engage with.

They've already responded in an adversarial way.. So they need to be taught a lesson in my opinion

Those rotten eggs are divine, that I can only agree. I have utilised similar measures with a a##hole of note that ripped me off horribly, the smell still lingers in my nostrils to this day.

Still, for me it's just not worth the bother. Much nicer to get their cheque following the judge's decision. With costs. Or their settlement on the court steps before the hearing. My smile and offered handshake is pleasure enough, because it's eye to eye, and I never had to stoop to their barbarity.

But how does the op go about doing that in a manner that he can reasonably expect a positive outcome and without being left deeply out of pocket?

Considering how over burdened and unhelpful our police force generally is and likewise the justice system.

I would not risk a normal court case without more evidence.

Small claims court, that's the way I'd go.

Delictual actions are not a criminal matter so don't really involve the police.


But your point is valid: proving this in court isn't that easy unless you have witnesses who are prepared to testify. Still, many similar cases have gone to court and the injured party awarded damages, with costs (so the defendant/losing party pays the other's legal fees).

If the op had money to burn then I'd definitely suggest trying to get a nice sized chunk of the women but if not then probably not advisable, revert to scorched eggs.

What's worse than being savaged by a dog?

On top of that paying R35000 in lawyers fees fruitlessly pursuing the remorseless sack of sh#t owner in court. Nevermind hours stuck in court/adjournments/paperwork/hopelessness
 
I was at the SCC again on another matter and there was a lady magistrate in attendance. She said there was certainly recourse through their offices

What is required, apart from a detailed report of the incident, is a vet and medical report of the wounds and their treatment, photos of the wounds (which I have), photos of the house and also the dog. She suggested to take along a piece of sausage and feed it in chunks to the dog, making sure the owner is not there and when it comes back for more, take the pictures. Also to enquire with the SPCA whether any other reports have been made within the past 3 years

The limit is of course R15000, but my medical insurance paid for my repairs
 
It's not the money that's important, in my opinion, but getting through to this dog owner that neither her dog's behaviour or hers are acceptable, and hopefully preventing any further incident.
 
Take her to the Scc, nothing better than when a skate gets their comeuppance.
 
After receiving a registered letter, lady advised her insurers (Helvetia) who jumped into action and requested a meeting and I took along my doctor, who was able to charge for the visit

They will pay the full amount of the claims, plus a "token" which to my mind is quite generous. After the meeting, the Helvetia lady (she was in the legal dept) said she should offer an apology for Mrs Faber's "uncalled for" attitude
 
That's a splendid result for you, and no doubt a good premium increase for the lucky lady.
