Until the clauses in the ECT act are actually enforced we will always have a problem with spam. Go government - good job as always!
I mailed one spammer recently and quoted legislation and threatened action and this is the reply:
Thank you for your mail and informing me of the legislation. I will most definitely go and look it up further as to what I may or may not do.
Regarding the canceling of your subscription if you look at the original mail it did state that should you not want to receive any marketing mails that you could respond to the mail by putting NO in the subject column.
Then regarding where I got your e-mail address from. I purchased a data base of about 100 000 e-mail addresses from a company called datacorp. I was ensured that it is legitimate e-mail addresses and that I could send marketing mails out to these addresses but needed to have the option to cancel subscriptions in the original mail.
I was also informed that I am allowed to send out a first mail (marketing mail) and make contact with a client but was not allowed to have a follow up mail without the consent of the client.

I do apologize about this and will most definitely go and read up on the legislation ad the act before doing any additional marketing or using the mail marketing campaign as I did.
