Two rapists lose appeal, get life sentences

Two serial rapists who appealed against their prison sentences of 20 years, have been given life sentences, Beeld reported on Tuesday.

The High Court in Pretoria ruled that sentences handed down by a magistrate had been too lenient.

In the appeal judgement, Acting Judge Jan Hiemstra said he got the impression that the magistrate had treated the matter as just another ordinary case.

Samuel Lucky Msimanga, Samkele Welcome Sibeko and two other accused had been convicted in the Springs Regional Court of raping a 24-year-old woman.

Msimanga and Sibeko pleaded guilty and appealed against their sentences.

The magistrate gave them each 20 years in prison after finding that there were factors that justified a lighter sentence.

These factors were that the two had pleaded guilty and that they had consumed alcohol, although they were not drunk when they committed the crime.

Hiemstra said the two had only pleaded guilty because they realised their case was hopeless because of conclusive DNA results.

The new sentences were backdated to October 17, 2012.

Man gets two life terms for rape, murder

A man who raped, and tortured an elderly Eastern Cape woman to death, was sentenced to two life terms, Dispatch Online reported on Tuesday.

Siyabonga Ntshabalala, 26, and his co-accused Zukisani Tulani, broke into the home of Kei Mouth resident Anne Roebert, 75, in 2012.

When they could not find the key to her safe, the pair decided to rape her to make her “speak the truth”, according to Ntshabalala's plea statement.

After that she was burnt with an iron and strangled with a cord.

Judge Nomathamsanqa Beshe said in the Grahamstown High Court that his callous crimes showed a complete disregard for the right to life, dignity, privacy, security and property.

“What resistance would a 75-year-old woman offer to two young men in their twenties?," asked the judge.

She sentenced Ntshabalala to life for both the rape and the murder. He was sentenced to a further 10 years for housebreaking with intent to rob, rape and murder, and 18 years for robbery with aggravating circumstances.

Tulani has pleaded not guilty and his trial was set to start on Tuesday.

KZN Rapist Jailed

A KwaZulu-Natal man was jailed for 15 years by the Maphumulo Regional Court for raping and robbing a woman, police said on Thursday.

Sphiwe Mkhanyiselwa Mpungose, 24, was arrested in 2011 for raping a 31-year-old woman at her house in Ocheni, said Colonel Jay Naicker.

"He attacked the woman with a screwdriver in her house while she was sleeping, raped her, and robbed her of money," he said.

Mpungose was sentenced on Wednesday to 12 years for rape and three years for robbery

He was arrested three days after the matter was reported to police.

Mpuma Teen gets suspended sentence

An 18-year-old school pupil was given a five-year suspended sentence by the Nelspruit Regional Court on Tuesday for trying to rape a five-year-old girl.

A Sapa correspondent reported that Mduduzi Lucky Mpila,18, from Barberton in Mpumalanga, had been found guilty of attempted rape.

Mpila, a Grade 10 pupil, had pleaded not guilty.

He was arrested in 2011 when the girl's mother reported that her child had been sexually abused.

Magistrate Willie Wilkins sentenced Mpila to four years' imprisonment. The sentence was suspended for five years.

Passing sentence, Wilkins said Mpila was 16-years-old when he committed the crime and had a chance to change his life.

According to a social worker, the girl was not physically injured during the incident and was coping well at school despite the ordeal, Wilkins said.

Had the teenager succeeded in raping the girl, the sentence would have been life imprisonment.

"You had a very good relationship with the victim's parents until your criminal act on their daughter... which changed everything. They no longer have trust in you."

The State had requested direct imprisonment, that Mpila's name be placed on the sex offenders' register, and that he be declared unfit to work with children and to possess a firearm.

"Your defence has argued against the State's request and said you are still very young and may need better employment in the future. If I agree with the State, doors will be closed for you as no employer would hire you," said Wilkins.

He said he was giving Mpila a chance to change his life.

"You are still too young... I am giving you a chance to change your life for the better. I have decided to agree with your defence, but all will depend on your behaviour during your suspended sentence."

KZN father jailed for raping his daughter

A man has been sentenced in the Verulam Regional Court to 10 years' imprisonment for raping his daughter, KwaZulu-Natal police said on Wednesday.

The 64-year-old man pleaded guilty and was sentenced on Monday, Captain Thulani Zwane said.

The man raped his 25-year-old daughter in the Ntaphuka area, Ndwedwe, in July 2011 when she came to visit and ask for grocery money.

He threatened her not to tell anyone, but she reported the matter to police.

Cape Cop to Appear for Statuatory Rape

A police constable accused of statutory rape was expected to appear in the Mitchells Plain Magistrate's Court on Thursday, the Independent Police Investigative Directorate (Ipid) said.

The constable from the Grassy Park police station, in the Western Cape, was arrested on Tuesday.

"It is alleged that the police official and the victim [14-years-old] have been having sexual intercourse between July and August 2013 at the policeman's house, which is in the same street as the victim's home," Ipid spokesman Moses Dlamini said in a statement.

The girl's friend told her mother.

Dlamini said each of the incidents had happened when he was off duty.

Meanwhile, in a separate incident, a constable based at Macassar police station was arrested after being accused of raping a 23-old woman in police cells on July 21.

She had been arrested and detained for housebreaking and theft.

"It is alleged that the victim had asked for toilet paper and it had been given by the suspect, who went back to her cell and allegedly raped the victim," he said.

The Ipid was notified the same day after she opened a case at the police station. It started investigating but the policeman went off duty and disappeared for a while.

He was tracked down and arrested on Wednesday and was due to appear in the Somerset West Magistrate's Court soon.

Ipid is an oversight body which investigates allegations of crime levelled against police officers.

NWest man sentenced to eight years for rape

A 53-year-old man was jailed for eight years by the Mahikeng Regional Court on Monday for raping a woman, North West police said.

The man raped a 50-year-old woman in Itsoseng Township, near Lichtenburg, in 2011, said Captain Pelonomi Makau.

The man learned that the woman was a dressmaker and asked her to accompany him to his house to stitch his trousers. When they got there, he raped her.

KZN man gets 18 years for rape

A 28-year-old man has been jailed for 18 years by the KwaDukuza Regional Court for the statutory rape of a teenager, KwaZulu-Natal police said on Tuesday.

He was sentenced on Monday for raping his 14-year-old girlfriend, said Captain Thulani Zwane.

The teenager's parents had asked him to stop seeing their daughter, but he continued the relationship and had sex with her.

The parents opened a case and he was arrested and charged with statutory rape, said Zwane.

Grandfather appears for rape

A 65-year-old man appeared in the Protea Magistrate's Court on Tuesday for raping his four-year-old granddaughter, police said.

"The man was arrested in Zola, Soweto, on Sunday in connection with the rape," said Warrant Officer Kay Makhubela.

"The incident happened on Thursday but the man was only arrested on Sunday after it was reported to the police," Makhubela said.

This was done after the girl told her parents what had happened.

The man would be back in court on September 17, when he was expected to apply for bail, said Makhubela.

KZN man gets five years for rape

A 22-year-old man has been jailed for five-years for a statutory rape by the Empangeni Regional Court, KwaZulu-Natal police said on Thursday.

The man was sentenced on Wednesday for raping his 14-year-old girlfriend in Ngwelezane area, said Captain Thulani Zwane.

The incident happened in February when the teenager was sent to the garage and she was delayed by the man on her way back.

She came home late and her angry father ordered her to return where she came from, said Zwane.

"She went back to her boyfriend and they were involved in sexual activities."

Her mother opened a rape case the following day and the man was arrested.

ECape Sexual Offenders Sentenced

Seventeen men have been jailed for various sexual offences in the Eastern Cape, police said on Thursday.

The sentences were all handed down last week, spokesman Thulani Mbambala said in a statement.

One of the culprits, 88-year-old Ntakopo Desi from Lusikisiki, was given a 10-year prison term for the rape of a 72-year-old woman.

The suspects were aged between 17 and 88. In another case 48-year-old Mbulelo Ntapo from Butterworth was given a 10-year jail sentence for the rape of a 13-year-old girl.

Lungile Ndululo, 37, from Grahamstown was sentenced to 10 years' imprisonment for raping a 42-year-old woman.

Rapist gets 10 year jail term

A 29-year old man was sentenced to 10 years' imprisonment for raping a 19-year-old woman in her house, KwaZulu-Natal police said on Thursday.

Captain Thulani Zwane said Manqoba Shandu was given the 10-year sentence in the Esikhawini Regional Court, near Richards Bay, on Wednesday.

Shandu broke into her home while she was sleeping on the night of February 2. He assaulted and raped her.

The woman reported the attack to police in Mtunzini.

The Empangeni Family Violence, Child Protection, and Sexual Offences Unit successfully investigated the case.

Teen raped in front of brother in KZN

Durban - An 18-year-old-girl, who was on holiday in KwaZulu-Natal, was raped in front of her younger brother at a Richards Bay beach.

This is the fourth attack at Alkantstrand Beach in the last four months, the Independent on Saturday reported.

In the latest attack, the two teenagers were walking on the beach at about 02:00 on Saturday when two knife-wielding men approached them.

The men robbed the teenagers and raped the young woman in front of her brother.

No arrests have been made but police are confident they will nab the suspects soon as the teenagers gave them descriptions of the men.

Police say they will increase police visibility on the beach over the festive season.
