ASA imposes “more severe sanction” against MTN after Vodacom complaints

So MTN can't use the name Bafanna Bafanna? What about all the other businesses etc? It's a national slogan, a national item. I don't agree with this, yes, MTN can't claim to be sponsor by you can't really censor a national team name during a world tournament?
 
Its great that this is what they waste there time on, stupid advertising and whinning, not giving the customer better service and deals...how silly would that be :(

When your company spends millions on exclusive rights and you have a department of lawyers then you might aswell go after your main rival for infringements :).

They should slap a monetary fine on them as well - R10mil to the Nelson Mandela Children's Fund.

I think as far as for competing mobile phone companies, they shouldn't be allowed to use the Bafana name. But a company not in the same industry, say Wimpy, should be allowed to use the name.
 
Well it looks like ASA is only forced into more serious actions if another corporate muscles in..
 
Firstly, well done ASA, for fulfilling your mandate efficiently and correctly; you're one of the few functioning public service organisations left in SA. There are several others *cough* ICASA *cough* who could learn a thing or two from you.

Secondly, IMHO, brands and trademarks are soon to go the way of the dinosaurs. They've outlived there usefulness, and should be put out of their misery, or at least have some very broad fair use regulations implemented. I won't go into the history and original purpose of brands, but suffice to say, lately they're only used to stroke yuppies egos and fill corporate coffers. ARRRRRRG.
 
MTN & Vodacom should rather spend the money on getting a few Mozambicans & Angolans here, bribe a crooked home affairs official and "make them" South Africans.

Then we might have a chance in the 2010 World Cup. :p

First you tried to bully little CellC, now it's MTN - do you really have to use your MegaBucks in this manner to score browny points against your competition? Or could this be your way of playing ostrich in light of your Congo situation, or some other bad press you've been facing recently?

Now just to get Vodacom to stop advertising BLACK iPhones which you cannot buy because they only import WHITE...
