384K uncapped account troubles

I paid R 1350 in advance for UNCAPPED 512 and at no point was i told that this would be implemented. I am going to sue and suggest everyone else does as well as they should have had the decency to give you a choice as to whether you wish to continue with them or not, failing to do so is tantamount to undue enrichment. I demanded a refund and this was the response i got: :sick:

Also have had problems recently via Openweb. Received the email today, - guess IS is looking for more income. Didn't know when I signed up for uncapped that it was actually for a “conservative business user”. :confused:

Anyhow I am not enamoured with Openweb's support - they only work office hours during weekdays and then when I tried last Monday, I couldn't get through from 8:30 until late afternoon.:( Fortunately I did not sign up for a debit order and just simply stop paying when I am ready to move on.

Now, any suggestions about where to go next?

I would like to apologise for any inconvenience caused.

We are willing to accept cancellations effective end July.

An Alternative account that I can suggest will be the 512k Uncapped Business account, which is unmanaged. This account requires the signing of a 12 month contract. it also offers 5 Static IP addresses.

We would like to thank all loyal OpenWeb clients for their support. If you do not wish to stay with your uncapped account, kindly mail us, and we can discuss your options.

Please note, the rate limiting will affect all ISP's that resell the Uncapped Express ADSL accounts.

I am definitely TAKING LEGAL ACTION:- and so should anyone who has been sold bandwith under false pretenses.
 
It's a pity that you wish to follow this route, but, if you insist, we will defend ourselves.

Keoma, I think your announcement that "All ISP's that sell uncapped accounts will have this applied to them" is unfounded. You and I are both aware that each individual ISP's has their own deals with Internet Solution and based on volumes. However should Internet Solution impose this on Online Digital Solutions we will refund clients on a pro-rata rate of unused days. Further to this we will provide alternative uncapped solutions not subject to 12 month contracts

I will ask IS to post an official response regarding their IS Uncapped Express accounts and the fact that all ISP's are shaped and limited equally.

Uncapped Express ADSL – Interpreting the service

This Business ADSL service has been developed mainly for the conservative business user who requires the assurance of an uninterrupted and fixed cost ADSL service. The Business ADSL Express service is a managed service, whereby the customers usage is monitored and recorded. The service is allocated a certain threshold for the month which is divided into a 10 day rolling window. If a customer reaches his 10 day threshold before the 10th day, his bandwidth will be halved (e.g. 384K to 192K, 512Kbps to 256Kbps and 1MB to 512K). However, if the consumption is reduced, the bandwidth will be restored to the purchased level. This mechanism has been put in place in order to discourage abuse of the service and thereby giving the conservative business user a more superior service.

The thresholds are as follows:
384K= 15 Gig for 30 days which is divided in 3 segments of 5 Gig each. The usage is monitored over a 10 day rolling window period. Should you reach these thresholds the service still remains uncapped but your download speeds are reduced by half (192K)
512K = 30 Gig for 30 days which is divided in 3 segments of 10 Gig each. The usage is monitored over a 10 day rolling window period. Should you reach these thresholds the service still remains uncapped but your download speeds are reduced by half (256K)
1024K= 60 Gig for 30 days which is divided in 3 segments of 20 Gig each. The usage is monitored over a 10 day rolling window period. Should you reach these thresholds the service still remains uncapped but your download speeds are reduced by half (512K)

This service is unshaped and no restrictions are placed on this service whatsoever eg P2P. A normal user name and password is provided for this service so clients may use there own routers. Though 2 x Concurrent connections are advertised, the second concurrent connection is designed to assist customers when there connection is sometimes locked on the network allowing them a second option to connect.
 
From yesterday afternoon we have only been gettin 7kbps and it went off like a light switch!

This such bs.They shouldnt been allowed to advertise it as uncapped as it is false advertising.I will be cancelling my 512k uncapped with openweb.

First off this was by no means an attack on you or Openweb. I just think that the comment was unfounded to announce "All ISP's". On a second note I would like to point out that Online Digital Solutions does not contract directly with Internet Solutions but through a holding company who's buying power outweighs most smaller ISP's and therefore the volume games comes into play. However as said before if this is applied to the our Holding company, we have upgrade routes available to all clients.

Once again I offer you the opportunity to work together in order to bolster our buying power and not allow bigger ISP's to become bullies.

All ISP's selling IS Uncapped Express accounts will receive the same bandwidth thresholds.

Discounts might come into play with large scale buying, which I do not argue for a moment.

However, when it comes to shaping and rate limiting, IS does not differentiate between one ISP and the next.

I also did not say ALL ISP's selling Uncapped accounts, I said All ISP's selling Uncapped Express ADSL accounts, which is a specific product of Internet Solutions, with specific features.

I however do not wish to further this conversation, as it has been dealt with extensively in a past thread.

I was thinking of going to an uncapped account, with student friends of mine, to split the bill and so forth.

Well screw it, if they can change the terms at will why bother with a contract and why bother. As far as I am concerned, the cheapest ISP selling uncapped lost my money.
 
I suggest a website, everyone refuse to pay their bills at once, that would be bad for credit rating but really how else can we get back at the ISPs who we all know won't stand up for our rights against IS.

I make the suggestion then, any ISP taking IS to court will get my full support and that of the community the ISP represents. ISPs, think of the customer goodwill.
