A long story perhaps, but one I need some good, solid advice on...

Morning folks.

I will try and keep this as short and sweet as possible in order not to bore anyone to sleep. Any advice/comments about this matter will be highly appreciated as it is a bit of a tough one and my wife and I are in need of some good, solid pointers so we can do the right thing.

My wife and I are unofficial foster parents to a child which comes from within our family, and we've been looking after her for the last 7 years from an age of 3 months old. She knows us as 'mom' and 'dad', even though she is fully aware that she does not technically come from us. My wife is in actual fact her aunt as the little one is the biological child of her older brother.

Said brother is a 48 year old tik addict who doesn't work lives in a garage on the same premises as we do. To support his habit he manufactures tik 'lollies' in exchange for his 'hits'. Since we have started looking after and caring for his daughter he has fathered a boy of 5 which lives with them in the garage, and we were horrified to find out a couple of months ago that his 'partner' has now yet again fallen pregnant, and is probably due to pop in January, with yet another child left stranded. She is also an addict which suffers from TB due to the drug abuse, and like her partner has little if any regard for the children they are so carelessly bringing into this world.

The brother was given a place to stay (by my mother-in-law, who owns the premises) when the birth of the child my wife and I have been looking after was imminent, and has been living here ever since, rent and responsibility free. He is abusive. He is violent when he hasn't had his fix. He DEMANDS food and money from his mother on a daily basis, and uses his children to blackmail my mother-in-law into giving him what he wants. Of course, she is a feisty old lady and doesn't simply give in, but eventually she does give in, if only to have some semblance of peace during any given day. She is 68 years of age and has to look after a frail husband of 74 which suffers from vascular dementia and is probably on his last legs, with perhaps another year to live. All this in between abuse, threats of violence, demands for money and food.

My wife and I have decided to say in a granny flat on the premises in order to be able to protect my mom-in-law from this piece of scum, because without us he would simply barge into her home and probably kill her, given half a chance. The only person he has a modicum of respect for is myself as I have had to take him down a couple of times, one of which landed me in court in front of a judge. I am actually an old-school boer and have to do everything in my power NOT to take this guy out when given the chance.

My wife, myself and mom-in-law look after the kids. We pay their schoolfees. We feed them. We clothe them. We bath them. We teach them the ways of decent people. In short, we do EVERYTHING for these kids, with not a single dead cent received from the parents as a contribution. Yet, the first thing that comes out of this abusive, obnoxious pig's mouth when he doesn't get food or money from his mother is that he will 'take his kids and line.' This has been going on for years, and while there are no more bricks flying through windows or bricks landing on roofs or backdoors being broken, the verbal abuse carries on and, to be honest, all of us are absolutely GATVOL of this guy.

As if this is not enough, being who he is he brings the dregs of society onto the premises to come and buy their lollies or swap them for a hit, and this on a Sunday afternoon when you are trying to have a good time with a child that isn't biologically yours and gets exposed to this kind of crap and abuse on an almost daily basis. It is sick and unacceptable.

My wife and I are expecting our first biological child in April next year, and we are torn between moving away from here to spare our newborn the abuse and staying here to protect my mother-in-law, who is getting on in age and has very little chance of fending for herself in our absence. To give you an idea, the situation is so bad that whenever the cops are called up to come and sort this guy out there is a collective rolling of eyes when they hear the address which they are to go to.

Our plan is to legally get rid of this idiot in a bid to afford my mom-in-law some semblance of peace in her last couple of years on this earth. We are however very concerned for the kids, especially our foster daughter, whom we've come to love and protect as our own, and we fear that the likes of welfare will simply take her away, or - worse - hand her over to her biological parents, with whom she's had absolutely zero contact, despite living on the same premises for years, and with whom she would most likely me whored out for a fix or three, the though of which is too much to bear.

If there is anyone out there who can point us in the right direction to get this situation sorted without harming the kids I would be very grateful for your advice. We want to get the ball rolling on getting rid of this bastard and we don't quite know where to start. We have approached welfare on numerous occasions, but despite promises of a visit to the premises they simply never pitch up and we are at wit's end as far as they are concerned. My wife and I want to be legal parents to her niece, who is an amazing little child, and we want to save the boy and the coming baby from the atrocious existence they are experiencing at present.

why haven't you reported him to the police? he has tik on him doesn't he?

if he contributes nothing and is a terrible father/son, it won't be a problem if he is gone. save the rest of the family and hand him over to the police

Holy crap, my hat goes off to you good sir. Sounds like you need some serious legal advice here, I wish I was more qualified to help out.

Can you not legally adopt your foster daughter?
 
This is terrible. But my advice to you is, dont keep scum close to you. Move away with everyone who is dear to you before you regret. If possible get police to lock up this useless object. Iam sure it cant be hard to find tik on.this dude.w
 
Hi guys, thanks for all the replies.

As much as I would have liked to get the ou locked up he smokes up all his goodies before the cops can get here. And apparently our wonderful law doesn't allow people to be locked up simply by owning or manufacturing drug paraphernalia. Pretty sick but that's SA for you.

I am going to try to get in contact with a social worker but it would be good to know what potential legal pitfalls there might be with regards to the kids. I don't give a #%$@ about the piece of scum, but the kids I am concerned about and would want them not to come to harm. They are innocent after all.

I'm sure we can, although from what I know they will have to basically sign her off to us willingly as she is considered a minor at her age from what I've been able to glean, and seeing that she's one of their pawns in twisting my mom-in-law's arm for food and money I gather such a proposal wouldn't go down too well with them. They are drawing benefits for her too, despite her not living with them, and it would mean they lose out on that bit of money, measly as it is, and that would also not go down too well. It is after all the money they use for their major monthly fix.

I guess we're scared that she could be taken away, which would break our hearts to be completely honest. We can't allow that to happen, so we need to nail this ou with minimal harm to her or her brother.

@ STS: The police are useless. One ex detective smokes tik with him, so you tell me how successful such a 'handover' would be. As with everything in life you need proof. The fact that you're a decent person and he's a piece of scum counts for nothing.

This is going to be unpopular, but having been a foster-parent - also under difficult circumstances - I have some knowledge of what you are going through.

Your order of priorities is very simple:

  1. Your wife and new child (congratulations on that, by the way): way ahead at number one. Get out of there ASAP;
  2. Your in-laws. Consider an institution for your father-in-law (in order to simplify matters) and plan on taking your mother-in-law with you.
  3. Your unofficial foster-child. Much as I hate to say this, you may have to leave her behind for the sake of your wife and new child.
This sounds very harsh, but the truth is that you have no legal claim to the child.

Add to that the fact that the aim of social welfare is to keep the family intact - even at the expense of the child - and you face huge problems.

Your brother-in-law will always play the "I'm taking my child" card 'cos he knows that it works: I've seen similar many times. Your only choice is to show him that it doesn't work, and that normally involves appearing to abandon the child by putting her in his arms and kicking both out the front door ...

Your best bet is a lawyer specialising in family law. They normally have contacts in the department(s) involved and, more importantly, have some idea of how to "game" the system.

As I [unfortunately] discovered, being a foster parent gives you no real legal rights, so approaching social welfare might well be a waste of time.

The final option - one that I considered - is to offer your brother-in-law a bribe to allow you to adopt the child. Unfortunately, he being family and literally "knowing where you stay", this would probably not be successful.

Hell, first off hats off to you. In this kind of mess, I think you're gonna have to save up for a good lawyer, unfortunately. I know MickeyD has some experience with foster parenting and hopefully he weighs in on this thread.
 
A girl I knew from school was in a bit of a bad situation at home and phoned the welfare and asked to go and live with her aunt and they organised it for her. Maybe try the welfare again?
Just don't leave the kids behind whatever you do. It will haunt you for the rest of your life.
 
you need to get out before your baby comes. your family comes first. your mom-in-law should then sell the house - not ideal i know but you cant leave her there with that addict. the hard part is getting that 'foster' kid to go with you. i dont think the addict will willingly sign over his rights. child welware should be able to help. declare him unfit and become offical foster parents. he wont stop. the situation will just become worse.

the bottom line is that you cannot bring your newborn into that situation.
 
I would take the foster child with,not like he cares or is going to come looking for her/you'll when you'll leave.But then you'll are basically living in fear of this happening...tough one.
 
The real "problem" is child welfare.

Their aim is to rehabilitate the entire family, with the foster family viewed as a form of temporary "bridging" assistance.

If the parent of a fostered child goes to child welfare and says that they (the parent) are enrolled in (for example) a drug cure program then the child will most likely be removed from the foster parents and returned to the addict and his/her family.

I have seen a six-year-old rendered unable to speak as a result of child welfare's good intentions ...
 
Not that I condone narcing but anyways this problem is serious. I had a thought. LeadSA has taken the drug fight quite seriously and reports left on crimeline are always followed up in full depth. Seeing as you have inside knowledge of his trade, why not go onto crimeline and detail the whole damn story. This way, you get a good chance of an arrest and possible conviction. Name the dirty cops too and basically clean house. This will make any legal challenge by you later on a hell of a lot easier.

I agree with what akescpt says. The righteousindignationcereb side of me would say hire a couple of nasties and kick the teeth out of his head, but lawfulrationalcereb is on the side of using child welfare's resources.
 
I would get the hell out of there if i had children.

Can you not get the home sold which would force the individual to move on, gets everyone out of that situation? You could then try fight for the children after the fact?
 
quite frankly, you may be better served by considering resorting to unconventional means in order to ensure him getting arrested

I tend to agree, mainly with the use of the term "unconventional means". I think the ship has sailed to solve this legally.

Maybe upgrade this piece of excrement and his breeding partner to something like heroin? Overdoses happen easily during such an upgrade. The only way this problem will ever go away, is if this guy is dead, otherwise it will never stop. Once he's vrek, the bitch wil be persuaded to give up her kids and GTFO very easily.

He begs and takes food all the time doesn't he. Just poison the fukker...no one will do an autopsy on his sorry a$$.
