the hard part is getting that 'foster' kid to go with you. i dont think the addict will willingly sign over his rights. child welware should be able to help.

It's unethical, but if that's what it takes, I'd offer the tosspot some drugs in return for signing over custody.

Can you not get the home sold which would force the individual to move on, gets everyone out of that situation? You could then try fight for the children after the fact?

Not that I condone narcing but anyways this problem is serious. I had a thought. LeadSA has taken the drug fight quite seriously and reports left on crimeline are always followed up in full depth. Seeing as you have inside knowledge of his trade, why not go onto crimeline and detail the whole damn story. This way, you get a good chance of an arrest and possible conviction. Name the dirty cops too and basically clean house. This will make any legal challenge by you later on a hell of a lot easier.

I would rather apply for legal Parental Rights and Responsibilities, take the kids with, and fight to keep them rather than fight to get them back. I wouldn't give those parents any chance to provide anything for those children that they could somehow twist around to say 'look, we can look after them'.

If OP has been caring for them since birth, it's doubtful that a social worker would return them to the parents if there is an ongoing legal dispute. I forget the terminology but when my parents were fighting over my sisters and I, it had something to do with ensuring the children maintain the lifestyle they've had until that point unless otherwise stipulated by a judge.
 
Wow, didn't quite expect the myriad of replies I've found here, but thanks to all for putting in your two cents!

Firstly I would just like to say to RRH that simply leaving a child behind that you've raised from birth, that has your blood, sweat and tears stamped all over her and has NEVER tasted life in the presence of drugged-up, violent parents is downright nasty. From a cold, logical and practical point of view, sure, this would probably the easiest way out. Unfortunately it is hardly as cut and dry as that in real life and to ask parents of ANY kind to simply throw a child to the wolves like that when all she's had is the best in terms of love and emotional nourishment, with NO contact whatsoever with the snake that fathered her is a recipe for disaster. Imagine everyone just gave up on a kid and ran away like that? It's a surefire way to ensure the further growth of an already sick society, and I'm sorry but she might not be my biological daughter but I love her with all my heart and there is simply no way that I will EVER allow her to be taken by those idiots. They'd be taken out before that happens, and NOT to dinner.

Every fibre in my being would LOVE to take this ou out for good, but then I have to ask: what kind of life would would I exchange my own for by taking the law into my own hands? I've already stood in front of a judge because I scarred his face, and right now I've got more important things to think about, like a baby coming and looking after our foster kid. If push comes to shove we will simply have to disappear, and at that moment I will make sure the ********* is disabled enough NOT to have a clue should he decide to open his gob about it. Believe me, I BURN on a daily basis with righteous anger at this pig, but unfortunately we don't live in the dark ages anymore, and to take out this little girl's biological father only to leave her with no father at all kind of defeats the purpose, to not even begin talking about leaving my own kid behind. Ain't gonna happen.

Selling the house has come up as an option. We would love to buy the house from my mom-in-law and then get his ass evicted (or forcibly removed if I had any say about it), but the financial means to do so is simply not there at the moment.

Either way I guess we'll just have to see how things pan out. I will however say that I do not think for one minute that welfare will go as far as forcing a child who's had the good life her whole existence into a garage with a bunch of addicts. The Children's Act is there to have a child's best interests at heart, and forcing it into a situation that can hardly be best for her is nothing short of inhumane. I have to believe that the people handling these cases have some sort of grey matter between their ears, but that being said we do live in good old SA, so I suppose time will tell what's what. If it looks like some idiot at welfare gets it into his or her peanut brain to force our kid to go and live with her bio parents you will see us disappear quicker than a ninja in the night. My wife and I simply won't allow such a situation to come to pass, and if idiot boy EVER shows up at my new place he will get a face full of buckshot, no questions asked.

Everything said and done I will be looking into the various options presented by everyone here and see if there's a way to walk which will have the least amount of casualties as an end result. Thanks for all the feedback once again and God bless.

Well done to you what you are doing for the children is amazing. Just wishing you all the best and hoping the druggy ODs and leaves you to peace.
 
@rrh, thanks mate, much appreciated. Judging by your personal experience we won't have much luck either, as it seems that the true welfare of the child is sold down the line in order to avoid all the paperwork necessary to legally kept and eventually adopted by the foster parents. Yours is certainly not the first uphill battle I've heard of, but it pays to do your homework, hence the original post on myBB. I just wish there was an easier way to get rid of the guy, but time will tell I guess. One thing is for certain: no government employee is going to come and mess things up for this kid, let me tell you. I remember doing some research a couple of months back and stumbling upon a case where, if the child is 10 years old, he or she can apply to be legally adopted by foster parents. Whether this is true or not I'm not sure, but perhaps the best thing would be to elope for the next 3 years and then go through the process from that angle. I don't know.

It's just swak that the good peeps out there seem to always draw the shortest straw when it comes to these things.

If anyone else out there has some actual experience with social welfare please post your replies here. The more info I have the better informed my decisions can be.

@ghostbuster: thanks mate. It's hard work and you're constantly on your guard but they make it all worth it. Our 'foster' daughter knows we're not her real parents, but we still have the privilege of being called 'mom' and 'dad', and it is a privilege indeed.

Gather as much evidence as possible while you have the chance (video with voice ) .
This sounds like it will end up in court one way or another .
When you have plenty evidence approach the family court i am sure they will help you.

The implications of which will be devastating. Has the potential to change a whole 2/3 generations. Heard of whole families in this. From grandma to grand kids.

It's largely ignored. It's mostly in the cape flats so you think you safe. It's spreading to the fancy areas. Maybe then something will be done.

My cousin we suspect is on it. Has stolen stuff from my dad's belongings after he died. Want to go ape***** on him. I don't know why I haven't yet. If he gives my mom a hard time he will see his gat though.

I wish there was a silver bullet for you OP. I would go to the mountain for it. Reality is that in the eyes of the law that turd still has rights. So tread carefully so you do nothing to harm your foster claim. Good luck.

Valuable advice there akescpt, thanks mate! Ja, funny how my wife has been saying that we need to build a case against these people, preferably video and audio, so I guess that's the next road we will embark on. Right now it's easy for them to get rid of any evidence, even though they're quite obviously scum and can be spotted as such from a mile away. Still doesn't do us any good if it all needs to go to court, which I'm positive it will do sooner or later.

Anyway, thanks for all the well wishes, it is much appreciated. I'm sure we will get on top of this. Until then the 'war of attrition' continues. Just wish I was a CIA buff in possession of some pinhole cams and mikes because I would rig their 'pozzy' stukkend. I guess it's been obvious all along that we're going to have to outwit this turd on the sly.

Get a gun, shoot in arm/leg if he rocks up on properly, phone and tell police station captain that they have not helped and prepare for the outcome should he arrive back.

send a strong message, get child services involved because he has a drug problem he can't "take
