Ah, here's the catch :

M&M makes computer waterproof computer accessories targeted to hospitals and labs. In 2001 the company developed a waterproof mouse that it dubbed Mighty Mouse. M&M began selling its mouse in March 2004, while Apple introduced its mouse in August 2005.

Think Apple will lose with this one.

The were sued for using the term iPhone as well...

Cisco were going to sue them since the name belonged to a VOIP product of theirs, but Apple and Cisco have chosen to share the name. Royalties would have cost Apple quite alot. I think both parties simply want to work together now...
