No, they didn't, it was mentioned, but the biased jury ignored anything that Samsung said.

To be fair, I suppose, it is not really within the jury's scope to identify false patents. Or is it ? Not sure.

That is probably just where the jury system falls flat, you need a judge - and not Lucy Koh !

But this should come up on appeal !

It is a matter of record that the prior art was presented, and it is a matter of record that it was ignored !

I have seen the prior art and it looks pretty convincing to me, some of it came from a decade or two before the iPhone/iPad were introduced.

Oh, and this evidence was accepted by some other courts, including Korean, Dutch and British. BTW, these were not jury trials and there were no Americans involved in the decision-making process.

If apple were suing because Samsung were using their hardware (CPU, GPU) or any tech assosiated with their hardware then I would agree on their course of action. However, now you have them suing Samsung who's tech is way better on soft/non issues in a bid to artificially increase or justify their premuim price on old or cheaper devices housed in a stylish package. Why only single out samsung on icons etc, why not Nokia, Sony etc... who have simular phones ? This all smacks of desperation and will be reflected shortly in the new iphone5.

A clone device would be prohibited under trademarks and copyright.

An Android phone cannot by definition be a clone, it does not run iOS

There is supposedly a Chinese company that have already produced an Android version of the iPhone 5 based on all the leaked photos, and are threatening to sue Apple if they launch anything similar in China. Should this be allowed?

Is what ethical? If the patents are valid, then it's not only ethical, it's responsible.

Wow, another Apple hater!

Apple sued Samsung because they are the biggest manufacturer of Android phones. Win against the biggest, and the smaller companies will roll over very quickly. Despite all the patent talk, what Apple are really objecting to was Samsung blatantly copying the iPhone design back in 2007, and marketing their phones as iPhone alternatives through the carriers in the US that didn't have the original iPhone.
 
Those are FRAND patents, and Apple are obliged to pay royalties.

They have refused to do so, and IMO all iPhone 5 shipments should be indicted.
