Article: Dewani walks free

UK businessman Shrien Dewani has been discharged on a count of murdering his wife Anni while on honeymoon in South Africa.

Deputy Judge President Jeanette Traverso granted an application for a discharge in the Western Cape High Court on Monday.
 
Haven't been following the case.... but wtf.
 
"I make the following order... the application is granted. The accused is found not guilty on this charge."

She said the only reason not to grant the application would be out of hope that the accused would implicate himself if he took the witness stand.

Could someone explain this to me?

Cue outrage from people on Twitter and other social media websites who have no idea about the law and criticise the judge.

I'm a layman but basically only one of the witnesses implicated Dewani, and his testimony was filled with contradictions.

in terms of section 174 of the Criminal Procedure Act an accused may apply at the end of the States case for an discharge, the reason for this is because it is the responsibility of the State to prove its case rather than have the defence do so for it; courts frequently have 174 applications reserved and continue with the trial.

In this instance the court has held that the State has not proved its case and to not grant the 174 application would only serve to hope that the accused self implicates (and you have a constitutional right against self-incrimination) and therefore grants the motion.

Its money well spent though... we will see a massive increase in Murder honeymoon tourism.
 
Expected this all along. Now queue the wrongful arrest case to be brought against the SAPS on top of all the money wasted already.

The private sector seems to have, on average, far more talented people working there than in the State (mainly related to pay).
