We had a guy here by my work not showing up for work or showing up late for work an a regular basis. He was counselled, given written warnings eventually charged and dismissed. The employee went to the CCMA and still lost the case. He then went to the Labour court. The Labour court then instructed the company to re-employ the guy. The court said, "How can a company dismissed a employee for time keeping! he needs to feed his wife and kids" He came back to work and was paid a full years back pay.
A very odd case...and outcome. A lucky bastard if you ask me.
