Where do you get this info from ?

If a cars mileage is over 10k km's, its no more considered as NEW. Insurance only replaces NEW cars that are wright-off's.

In this country murderers take so long to get convicted, what is an accident like this with no casualties ?

there is no new RS4 ... they stopped making them .. he might be lucky if there are still some at the factory ...

As far as I know, stock were sold out months ahead, when it got discontinued. Orders were fulfilled but I severely doubt whether there are some extra ones lying around.
I really feel for this guy! The closest equivalent I can think of, to the RS4 is the new M3. Awesome car, yes, but not everyone's cup of tea.

I was not saying there is a new RS4, i was just saying insurance does not replace a car that is over 10k km's. They will repair it.
 
I would sue them for the Audi R8.

You think its that simple ? Audi dealer will say the mech was not allowed to drive the car blah blah ... the mech is now liable, and he doesnt have money. go to court, wait years and spend thousands on court fee's,lawyer fee's,advocate fee's, end of the day, its a waste of time. Thats why he is insured, to get his car fixed, or written off at the retail price of that specific RS4, and buy a new car.

Audi can say what they like about it being the mech's fault, they are still responsible from the client point of few, if the mech took the car without Audi's permission, then Audi needs to report it as stolen to the police.

If the car is within its first year of registration, it will be replaced or full retail value paid out AFAIK. This is how it worked for me as explained by my insurance company, and as was explained by my ex-fiance` who works in insurance...

Yes that is what insurance is for, however the insurance company and car owner will have a legitimate claim against against Audi. Their employee acted on behalf of the company - simple as that! He did not act in a private capacity when he took the car. And I can assure you that the dealership will want to resolve this as quickly as possible...
 
In future when you take your car for a service , make them sign indemnity forms assuring you that you will get your car back.

i will do that cos they make me sign forms if they give me a loan car for the day.

I was in an accident in my Citi. A short while after it was fixed (at insurance's cost), it was stolen (hmmmmmm...). Insurance actually paid out more than I paid for the car (since it was less than 1 year old and still valued at 2006's price, which had increased throughout the year).
 
also wrote off my first runx rsi in 6 months and insurance gave full retail value of a new one, so i bought another one ;)
 
This is heart-breaking, upsetting and frankly very concerning. I have actually wondered myself what these guys get up to when 'testing' your car and regularly check the KM's when I drop off for a service.
I'll crap my pants and then probably feel like killing somebody if this happens to my S3, not even to say the RS4.
Damn...
The AUDI dealership is responsible for this. The guy's insurance should not even come into this. The dealership was negligent. Period.
 
Reminds me of that Schuster gag from the 80's where Shuster plays the mechanic who has written off the beemer belonging to the lanky character in the all white outfit.
