I don't think it will be legal to use inlicenced spectrum for technologies which require government licence. They try to use possible loopholes in legislation, it seem to me.

Speaking about performance, the article is misleading. WiFi typically brought advanced modulation and MIMO techniques before all others.

Mobile operators already have a license (ECNS & ECS) and wisps already operate in the unlicensed spectrum also requiring ECNS & ECS licenses.
