Calendar Month

I have in writing saying 'new position is conditional to you cancelling CCMA. Please bring to proof of cancelling to your meeting'

Reason I didn't go ahead is because I weighed pros and cons of staying or leaving. CCMA would more than likely have given 3 months. As this was November, I'd only have a salary to Jan ... With no one hiring in that time. I'd rather have a guaranteed job

I'm not expert but I'm pretty sure that is highly illegal.

I would get a few months salary out of them once you've moved on just for being ****s.

There is that as well actually..

Keep all the shyte in writing that you have. Insist on leaving 31st Jan. Let them have the disciplinary hearing and fire you then get a few months extra salary from them through the CCMA.

Companies like this actually need to be taught a lesson.

Okay good, so I'm not wrong that it's very dodgy to do that.
 
Okay so Dolby has a very strong case with the CCMA... but now, lets say it all goes into legal battles, wouldn't the company just put our their lawyer and let this drag out in court for XXX months/years and it'll cost Dolby waaaaaaaaaaaaay more?

Ccma will represent him. Also lawyers are expensive and it'll cost them more than its worth imo. Unless Dolby is earning millies

Pretty much this.

Unless Dolby is earning R100k pm +, it would be cheaper to just pay him out.

ahhhhhh ok didnt know that they represent him, thought he'd have to get his own personal lawyer. Ok then lekker! go boy, CCMA!
 
No, I don't earn alot at all ... that's how I know this isn't about money ;)

They could, actually, take the resignation, easily pay the notice and say 'whew -he's gone'. It's ego / power / vengeance ... no one dares speak back our management, and I dared :/

I have had a look at your post history to figure out what is going on here.
This is probably one of the worst stories I ever came across... Sjoe..

Then make them pay for their arrogance dude...

The CCMA will take them to the cleaners.
