How will the bank know the money is from "online gambling" ? Can't you say you won the "Yahoo Lotto Draw in the UK " and flew there to pick it up?

ok, take Playeuromillions/megamillions for example, on your birthday, they give you a "free" entry. now what happens if you win the jackpot with the free ticket? you didnt pay ..there is no contravention of the credit act..since no money was used to purchase the ticket.? right? and secondly is it then illegal to advertise gambling facilites online in south africa?
Is it illegal though to play the euromillions etc..

from within south africa? what happens if you worked overseas , say the uk and had a UK bank account and credit card and entered from within south africa but paid using your foreign card?
I'm quite interested in the free ticket and if you win, but are you saying even if you win with a non paid for ticket, but entered from within SA your winnings would still be illegal.

Are the winnings still illegal if you declare them? Getting whacked for tax is a lot better than not having any money at all.

It is still illegal, except if you are a member of parliament or a sinior ANC member.

The money you win overseas is subject to overseas laws. You have to be physically present though overseas. SA cannot regulate foreign laws. They can only regulate what happens here. However, they may want to tax or confiscate your winnings in which case, if it's a lot, spend that money abroad or leave SA for more than 180 days per year (whatever it is) and you don't have to declare those funds. Alternatively with a big win, emigrate as most countries will take you. A US Green Card costs $350,000 I think in investment in certain US government sponsored things. If you hold multiple citizenships, then you have no issues.
They could still nab you for tax evasion.
It's all just governmental greed - covered up as hunting for terrorism and organised crime.
Ask them and get it in writing.
Eurolotto look at 'Country of Residence' and you need a bank account in THAT country. Its illegal to even play a game which competes with the LOTTO type system in SA. No-one will stop you playing, but they sure as hell will find an excuse NOT to pay out.

Yes that is quite hypocritical. The SA Gambling Board is clearly making no effort to inform the public that online gambling is illegal (if it really is). You can see African Palace Casino and Piggs Peak adverts everywhere. What surprises me is that even mainstream news sources like News24 and IOL allow advertising for these online casinos. Surely if it's illegal then these newspapers are doing it while knowing it's illegal? Doesn't it make their actions illegal too? Most radio stations in SA advertise these online casinos too. Even when you play some of these radio stations live online, it usually starts with "this station is sponsored by fill-name-in casino!"
As one post on the Carte Blanche site mentioned, the Carte Blanche casino story aired at 7h15pm and an hour later... MNet themselves ran a 30-second TV AD for ...African Palace Casino! LOL What a farce.
In the USA they restricted online casinos quite easily; instead of taking the casinos to court, they just made it illegal for credit card companies to process online gambling payments and therefore the credit card company is held accountable if they process online gambling payments.
Imagine if News24 and iAfrica were advertising Child Pr0n websites or cocaine sales in Columbia. Same analogy.

Think i need to let all my friends who play online poker know that they may get nothing out of it.
What a scam, not only by these casino's who advertise everywhere, but by the gambling board, and the media who happily take money for the adverts.

The way the legislation is drafted it makes no difference where the servers are based, where the gambling license is held, etc. If you are gambling on a computer while in South Africa, its illegal. I have always known this, but that didn't stop me from gambling. I used to play a lot of online poker and still use my Betfair account very regularly. My view is that while it may be illegal, I see no reason why the South African government can tell me what I can and can't do with MY money, especially as far as gambling goes. Exchange control is bad enough.
Also, gambling in South Africa is now allowed. So there is no problem with the act of gambling. In terms of the Act, online gambling was made illegal, but the act also provided that Parliament was to enact legislation that would allow for, and control, online gambling. This was meant to be done within 2 years of the National Gamling Act. That was yonks ago. So, if Parliament had pulled thumb, like they were supposed to, south africans keen to gamble online would have been able to do so without falling foul of the law. By not doing this, they are forcing us to become criminals and also exposing us to risk. If African Palace had been licensed, that poor lady would never have gotten into a situation where she had to beg for her money.

If its SA lotto, then I dont see a problem... if its ANOTHER lotto that is run outside of SA, then that is a completely different story.
