Complex refuses Vumatel Fibre

Our complex was simple, it was on a opt-out basis. Everybody got fibre, unless you said so. Do the same. I am 100% sure the fibre installers would be willing to skip the houses that "do not want" it. This way everybody gets what they want.
Perhaps make those that opt-out sign a waiver, to acknowledge possibility of future installation cost etc.
How? If they don't pull fibre into your property, there shouldn't be any damage? Openserve pulled their fibre through their existing pipes. At our complex we had 2 owners not go for it and they were skipped. Vumatel simply trench in-front of their driveway on the communal property.
This is interesting as vumatel told us that its all units or nothing. I will query with them .

The communal property is "their garden and pavements" too, and they'd be trustees. If your experience is otherwise, then you are lucky.

Thats the plan, we are trying to get vumatel to come by and present to all of the owners.

Some of the units don't have telkom lines so trunking will have to be installed, as for routing through the sewer , what happens if there is an issue in the future ?

Vumatel has stated that they will reinstate to how things were originally but from what 'we've seen in the area they don't mean that . So this is one of the reasons why residents are reluctant to approve. I have told them that the tar will fade and the grass will grow again but this doesn't seem to convince them . I personally held of tarring my place because I knew I wanted fibre to be installed.

The main reason we want to inform all owners and get their approval\signature is so that we don't get anyone suing the HOA for damages.



I'm one of the trustees and definitely want fibre. So far majority of trustees are for fibre but there are two that are worried about their gardens:cautious: one who says she has no need since she is quite old.

However




It is a sewer drain type system that infact contain the electrical cables as they spread through the complex. Fibre enters complex just after where CoJ power cables are connected to the internal cabling in the complex.

They had to do very little digging as explained before

You can't sue a HOA when its acting on behalf of its constituents. Surely you can't have 1 or 2 trustees running the whole show? Whats the point of the HOA then?

We also have these in our complex, but they belong to Openserve. Quite funny as they are very elaborate for just telephone wires, but the water and power has to go through their own piping... seperate from the manholes.

That's why you request an SGM - once seconded it has to take place within an given time frame.
 
Meeting has been set already and all members notified , there will be a vote at the meeting.
 
The area surrounding the complex is currently getting fibre so a potential buyer could say I will offer you less since there is no fiber in the complex, take it or leave it . A home owner then says that because of the HOA I lost out on 3% extra on my sale , I want the HOA to pay.

You can waste your money and Sue then, you loose they then increase everyone's Levy's to pay for the costs or the courts order your to pay for their legal costs.
And youv can't seem to grasp the fact that you are part of the HOA, you in effect suiing your self.
Go to a lawyer and get told this.

Along with all the painful new laws there is that 1 olive branch.
Remember X% of land/building owned represents the new minimum. So the more big home owners arrive the quicker the limit is reached. Also each vote is now represented by the percentage of the greater property that they own...

My complex is 27 units I think like only 5 units (might be less) including me are actually in fibre.

That's the way Metrofibre also did it for us. Trenching/terminating is free as long as they can terminate every unit. Sounds like something you can't get around, unless your complex has money to burn, which most won't.

Making it more desirable is not an increase in value. The same can be said if I want to build a Balcony and it doesn't fit with a sectional title look and the Trustees reject my application. Like I said it's a waste to go this legal route, rather get buy in the friendly way.

As for the box technically it's not 1 box per unit, 1 box can be shared by Max 4 units ( they try to keep it down to 2) so my unit does not have a box in my wall, my neighbors do ( even though I asked for the fiber and would be fine with) so my lines comes from next doors box. So an idea is to take into consideration those that don't want and manage the box placement based in this
 
Trying the friendly way first, if that fails then legal will be the way .

How far is the distance between the different units 1km or something:cautious: have you received a plan from Vumatel to confirm this? The free standing houses in my neighborhood are sharing boxes.
I live in a full title house in a complex and yard is my property so yard and wall etc at my property so not even common property, and we sharing boxes.
I got it right, cause I talked to my neighbors, just have to be diplomatic explain the issue and benefits.

Seriously the legal route is a waste you can't Sue your self, you might as well move out you not going to be popular with your neighbours.

As I said this will only be the case as a last resort, so far there are units that want fiber also so hopefully at the AGM we can convince everyone to say yes . If one or two people refuse then it should go ahead as majority agrees.

Very odd they doing that with the boxes.
Any way good luck I doubt you will have an issue most of the time as long as they understand and its explained it will be better and won't cause much of an issue they should vote Yes
