Krugersdorp cops not in their right mind at the time - MEC

Johannesburg - Community Safety MEC Sizakele Nkosi-Malobane has defended the Krugersdorp police officers, saying they were "not in their right mind" when they acted.

Nkosi-Malobane was speaking on Thursday at a commemoration event of Gauteng SAPS members, who had been killed on duty since last year.

The Krugersdorp officers were allegedly involved in the killing of Khulekani Mpanza, after he fired shots at a police van.

The officers now face charges of defeating the ends of justice and murder.

Referring to the Krugersdorp officers, she said: "Remember these are people who have almost just lost their lives, they were not in their right mind [when] they responded the way they did."

She said it was ultimately up to the justice system to decide who was actually in the wrong but it was also the responsibility of the media to report on the manner in a balanced way.

It's there today (local)... right outside her house. Had stopped to turn into her driveway and the shooter walked up tot he car and executed her. Sick world.

Krugersdorp 'execution' cops denied bail

Krugersdorp - Three police officers accused of shooting dead a suspect in cold blood were denied bail in the Krugersdorp Magistrate's Court on Friday.

Magistrate Keith Page rejected their bail application and said although the State had not opposed bail, based on the CCTV footage of the shooting shown to the court, there was a clear prima facie case for murder.

"It has been established that an excessive degree of violence was exerted on the deceased," said Page.

"The CCTV footage shows accused number 1 approaching the deceased who was on the floor, elbows bent with his hands covering his face, showing no resistance to the police."

When the suspect was on the ground, the police could have made a successful arrest, but they did not, said Page.

Constable Titus Mabele, Constable Jason Segole and Sergeant Puleng Sebetwa face charges of murder and defeating the ends of justice.

'Execution' cops' bail denial is racist - Popcru

Johannesburg - Popcru president Sizakele Cebekhulu has described Magistrate Keith Page's decision not to grant three Krugersdorp police officers, accused of murder and defeating the ends of justice, as "racist".

"We are faced with a racist decision here," he told a large group of union members standing outside Krugersdorp Magistrate's Court on Friday.

"All the processes of bail have been exhausted, still the magistrate finds it possible for him to keep them inside. We are not going to agree to this," Cebekhulu said to the group, as it chanted "Why?" and "Down with a racist magistrate, down!"

Earlier, Page denied Constable Titus Mabele, Constable Jason Segole and Sergeant Puleng Sebetwa bail. The trio was allegedly caught on camera killing Khulekani Mpanza, a suspected robber.

During his judgment Page said the State's decision not to oppose bail was "ambiguous".

"The position of the State on bail is ambiguous at best and did not take the matter any further."

'Not flight risks'

He accepted that although the officers were not flight risks and that the likelihood that they would intimidate any witnesses, the CCTV evidence against them showed that they had used excessive force during the commission of the crime.

The video footage showed the police chasing a gun-wielding Mpanza down the streets of Krugersdorp, west of Johannesburg. One of the officers fired the first shot which resulted in Mpanza falling to the ground and dropping his weapon.

The footage then showed another officer kicking Mpanza while another officer fired a second shot.

During his judgment, Page told the court that the officers could have made a successful arrest after Mpanza fell to the ground, as there was no sign of resistance.

"The CCTV shows accused number one approaching the deceased, who was on the floor elbows bent with his hands covering his face, showing no resistance to police.

"It has been established that an excessive degree of violence was exerted on the deceased."

Meanwhile, the SA Policing Union has vowed to take Page's decision to the High Court.

"We have made a promise to those members that we are going to the High Court, where another court will give a better judgment than this one," Sapu deputy chairperson in Gauteng Peter Ntsime said.

Denied bail is fukking harsh. Guess you only get bail if you shoot your girlfriend not armed robbers?

Pretoria- The Independent Police Investigative Directorate [Ipid] on Saturday called on unions to not turn the case involving the Krugersdorp police officers accused of murdering a suspected criminal into a racial matter.

Ipid spokesperson Grace Langa said they were surprised by the reaction from the unions after the three of the four officers were denied bail in the Krugersdorp Magistrate's Court on Friday.

"We don't understand why unions make the Krugersdorp matter a racial issue... The magistrate is simply doing his job and he saw the judgement for bail relevant for that case [in the] same way they, the Krugersdorp police, saw it fit to finish off Mpanza," she said in a statement.

Four police officers were arrested after the Sunday Times newspaper two weeks ago reported that CCTV footage showed the police officers killing Khulekani Mpanza in cold blood, after he fired several shots at the police officers.

In the footage, police are seen chasing and then shooting at Mpanza who falls to the ground, dropping his weapon.

Another police officer however, is seen moving closer to him and apparently firing another shot at a disarmed and wounded Mpanza, killing him.

One of the officers who was charged with defeating the ends of justice was granted bail earlier this month while the other three, who face an additional charge of murder, were denied bail on Friday.

Delivering his ruling on the bail application, Magistrate Keith Page said the officers could have made a successful arrest after Mpanza fell to the ground as there was no sign of resistance.

"The CCTV shows accused number one approaching the deceased, who was on the floor elbows bent with his hands covering his face, showing no resistance to police.

"It has been established that an excessive degree of violence was exerted on the deceased," Page said.

But a disgruntled Popcru president, Sizakele Cebekhulu, told union members outside of court that Page's decision was "racist".

"We are faced with a racist decision here," he said.

"All the processes of bail have been exhausted, still the magistrate finds it possible for him to keep them inside. We are not going to agree to this," Cebekhulu said.

Langa said it was surprising that the unions who had labelled the judge as being racist had ignored the fact that the prosecutor in the case was also white.

"Surprisingly, the prosecutor who did not oppose bail is white and nothing is sad about it cause it is in their favour," she said, adding that those who were dissatisfied with the magistrate's decision should appeal the decision instead of "playing the race card."

The SA Policing Union has vowed to take Page's decision to the High Court.

"We have made a promise to those members that we are going to the High Court, where another court will give a better judgment than this one," Sapu deputy chairperson in Gauteng Peter Ntsime said on Friday.

Meanwhile, Langa also called for the unions to not victimise the person who provided the footage.

"The poor man who helped to bring the video forward is now blamed for racism all because he exposed the officers," she said.

The four officers return to court on December 2.

Murder suspects should never get bail on strong evidence!
