'KFC five' charged with attempted murder


The trial of five men accused of assaulting a couple in what is believed to be a racially motivated attack at KFC in Montana‚ Pretoria North‚ will resume in February next year.

The men - Stephen Nel‚ DJ van Rooyen‚ Joshua Schultz‚ Ockert Muller and Marius Harding - appeared in the Pretoria North Magistrate's Court on Monday‚ where their case was transferred to the regional court for trial next year.

They were all charged with attempted murder‚ assault with intent to cause grievous bodily harm and pointing of a firearm‚ after they attacked a couple in August.

Yeah, again, rape/assault/robbery seems to be perfectly acceptable in prison, just not on the outside.
 
Good to know anytime someone pulls a mugging, robbery or hijacking, they'll now be charged with attempted murder too, no more 3months etc:whistle:

In general everyone in a party will share charges. If your friend beats a man to death (after you just beat him lightly) you will still be charged with murder.

However sometimes there are circumstances which will change outcomes between different persons. BUT some charges like pointing of a firearm are just slapped on there by the prosecutors to make the charges look more serious, tbh.

Ongoing KFC drive-through assault case postponed

The case against five men accused of assaulting a couple last year at a KFC drive-through in Montana, Pretoria, has been postponed as the defence is waiting to get access to a cellphone belonging to one of the accused.

Marius Harding, DJ van Rooyen, Stephan Nel, Joshua Schultz and Ockert Muller appeared in the Pretoria North Magistrate's Court on Thursday morning where the court heard that most of the disclosure of evidence had been complete.

Prosecutor advocate Lucri Shivambo said all the CCTV footage of the alleged assault had been handed over to the defence teams, but that information from a cellphone was still outstanding.

Last year, the court heard allegations from Harding, the only co-accused in the case still in custody, that he had been the victim of multiple assaults and theft at Kgosi Mampuru II prison.

"He has been assaulted on various occasions, his stuff has been stolen and the individuals at the institution do not want to assist him to lay charges or assist him with [a] transfer request," Harding's attorney Nols Nolte told the court.

Defence in KFC assault case accuses police of delaying the matter


The defence claims the police are deliberately delaying the case by refusing to furnish them with a cellphone belonging to one of the accused.

The defence attorney of the five Pretoria men accused of assaulting a black couple at a KFC drive-through has accused the South African Police Service (SAPS) of deliberately delaying the case by refusing to furnish them with a cellphone belonging to one of the accused.

Advocate Nolse Nolte, who is representing three of the accused, including Marius Harding, whose cellphone is still in police custody, told the court on Thursday that his client informed him that the cellphone had crucial information, hence they wanted to use it as part of their evidence.

“If we can’t get that phone, we won’t be in a position to prepare for trial,” said Nolte.

Nolte asked the court to draft an order that would compel police officers to hand over the cellphone.

What sucks about this is that those guys are getting punished because of the racial aspect. Aholes like these get away with this all the time, stacking up assault cases left and right.

I sincerely wish our society would punish assault more seriously regardless. These tough guy bully sorts are the type that cause a lot of harm in our society (road rage, wive beatings, etc.)

KFC assault trial postponed to September

Pretoria - The case against five Pretoria men accused of assaulting a black couple at a KFC drive through last year, has been postponed to September.

Defence lawyer for three of the accused, Advocate Nolse Nolte, requested more details from the State, and said while he had received the docket questions still needed to be answered.

A video taken with a cellphone went viral on social media, showing the five accused verbally and physically assaulting Jacob and Dudu Sono on August 3, 2017, at a KFC outlet in Montana.
