You are misreading the post.

Cheapernews has been blocked because we haven't responded in a 'timely' fashion to a copyright complaint lodged against one of our IP's. We are a signatory to the Geneva Convention which has a few downsides. Being blocked is as a result of ignoring the complaint over Xmas. We are legally obliged to pass on to the IP/client the RIAA threatening and legal letter.

Correct. Otherwise you as an ISP can be guilty of breaking a few laws.

Geneva Convention? :D

Berne Convention is the one you are looking for (unless you are hoping that the recording industries will treat you proper)

was this a take-down notice? sounds like something that was passed on from an upstream provider and they have blocked access in terms of the contract you have with them?

copyright and ISPs is going to be a major issue in 2010 and all ISPs will need to be very careful about they deal with these things.

@ this stage my take is as follows: there is only a legal obligation on an ISP to act where they are in receipt of a valid take down notice issued under the Electronic Communications & Transactions Act - there is no other legal mechanism to be used (and the recording industries in SA are well aware of this)

where the document is an "infringement notice" or some such thing, usually quoting the US Digital Millennium Copyright Act then there is, imho, no legal obligation to do anything

I appreciate the information. We're waiting for everyone to be back in contact and at work to sort this out. i.e. Tomorrow. I'm making assumptions at this stage based on symptoms.

But why? My downloads were going so well these last couple of days. Like I said before, I got this account for one reason, to download and if the speeds keep on getting dropped and dropped every time then this account is not for me anymore.
 
Why don’t one of you guys setup a DC server, I remember we did it back in the day on iBurst.
By the sound of it you guys should get pretty decent speeds between each other.
