Wait a sec. You keep referring to display shells. These are the ones intended for displays, right? Hence the name. The ones that require public display permits and permission from authorities to fire?
You did no such thing? You told us that modern fireworks are not loud. You also apparently fail to understand how a dog's hearing works with statements like "it's just a pop", irrespective of how absurdly false that statement in and of itself is...
From that FB story that family should be reported! A person using fireworks and your dog jumping into the pool is not the user's problem! Its not as simple as saying whose at fault but rather looking at the incident subjectively.Fireworks users are never responsible for their actions if a pet is injured or killed. Ever. Nor when a child is injured or killed.
If their windows rattle from a firework then hell yes.they live in a cardboard box
You're being ambiguous with this term, a better name would be display firework or display rocket. The noise it emits is not even close to a nuisance firework.Rocket fireworks are not nuisance fireworks, even if they make a noise
Everyone that disagrees is intolerant as anyone without a bias can see it from your view point.Everyone who disagrees is racist and is the problem with this country.
Oh, good lord. Of course the law is subject to interpretation! That's the whole reason why courts are presided over by people tasked with ensuring laws are applied in accordance with the spirit they were written in.the law is not subject to your interpretation. If they were one and the same they would not be defined separately
I blame the person detonating the firework.then dont blame the firework
Nope, I blame the person down the street for thinking he is special enough to warrant me taking abnormal steps in securing said animal. You blame the person down the street because you didnt enclose your animal properly ? ...
I'm unsure... Was that an attempt at English?Im not wrong. Its within the boundaries of the hindu community by law. See loaded question
We're discussing explosions loud enough to drive animals to injury in spite of reasonable containment.Again responsibility of the owner of the sheep to ensure that their enclosure can house them properly and securely. Go on check it up its in the law you lot like to refer to.
he shouldve had a proper fence
I've had multiple times more legal schooling than you. It's safe to say you've not a clue what you're talking about.Nope 2 law modules. 2 written exams and 1 oral per module. Resulting to insults now are we ? shame those also dont work in law, actually hurts your case
News flash: municipal bylaws trump national legislation.really? im not the one passing recommendations as an act. Again provide the regulations of the act then talk. Thats if you know what regulations are lol
If it makes a noise audible for kilometres around it's a nuisance, regardless your protestations. It is not considered a nuisance firework. Therefore by legality all subsections prohibiting fireworks defined by "nuisance" do not apply to this class of firework. Your subjective opinion again has no bearing
Not at all. They also apparently research EVERYTHING, even if poorly, [-]drawing[/-] writing theses as they go along.ah the infamous 'tablet counter'. If you think this is all a pharmacist does then its no wonder you are battling to understand the law.
Nope. People who insist on acting like ****wits under the pretence of culture and custom do that. As do the ****wits ineptly defending them. You people prevent racial and cultural cohesion among people. That is why people throw the race card at you. You are no different from people like Malema. Though you too blind to see it

So after agreeing with me earlier in this thread that people should be considerate and not let off noisy fireworks, you've now decided that that was a mistake and we're back to fsckem, it's legal?
You really need to keep your story straight if you want to bullschit at RiaX levels...

Gotta love how a dog that is scared of loud explosions (meaning 90% of dogs and 90% of other animals) is a poorly trained dog.
You guys need to get one of those devices they use at car sound show so you can measure and report back your definition of "loud".
Consideration works both ways, your definition of "noisy" is subjective.
Anything with a bang
Anything with a bang. You agreed to this earlier. Your colours have now shown. You were never in agreement. You simply lacked the faculties to respond in any manner that backed your perspective. So instead of admitting fault with your logic, you simply decided to agree with me in the hope that I'd forget and you could troll the thread later. Martin Bailey thinks you just hit the booby trap...
ExactlyIf fireworks result in the injury of a person or an animal, then the person responsible for setting off the fireworks is civilly liable. If the firework itself is illegal, the person responsible is both civilly, and criminally liable.
Nobody I know really uses fireworks as its Diwali rather cause its that time of year that they can use it. Diwali, Guy Fawkes same period.More importantly here, are the number of animals that through sheer desperation in their efforts to get out of a situation that they do not understand, and is often tantamount torturous for them, land up getting loose and are run over or lost. In my experience few people who celebrate Diwali actually take cognizance of the fireworks and their intended meaning. Instead it is simply an excuse to let off fireworks for the sake of it and it becomes a competition for the biggest and loudest bangs.
okWhen I was a teenager I had the same mindset. Luckily I grew up and developed an understanding of the repercussions of my actions, and subsequently put an end to my bursting of loud fireworks for the sake of it.
Diwali was on the weekend, Guy Fawkes was during the week and as I can see from some posts no fireworks were used which you was wanting? Display rockets involve light. In this case all that pet-owners and people who actually work after Diwali and Guy Fawkes are asking is that people adopt a similarly mature logic when deciding what fireworks to burst. It does not have to be loud. The light significance is in effect metaphorical in any case. No Hindu believes that his fireworks have truly warned off evil spirits for the rest of the year. So just be responsible. There are a ton of legal fireworks that don't involve bomb-like sound effects. Enjoy them, by all means. It is about the light in any case, not the sound...
You're not a layman. You're an expert. On everything. Like speed measurent. Not yours but the courts ... big difference. We are laymen we follow the law we dont interpret it.
blame them all you want. Its their right set down by the republic of South Africa to discharge fireworks should their municipality deem it acceptable
Nope. Reasonable containment is a requirement.Nope its not abnormal its required by law. Go look
Short of being drugged out its skull, or dead, an animal is capable of injuring itself. Your assertion isn't practical.or perhaps its a response from a lack of understanding ? animals do that they get startled. If the animal is capable of injuring itself within its containment then that is not acceptable housing.
Like 3-and-a-bit years of legal study at 'varsity.like what?
Who said we are?NEWS FLASH we not arguing the about the areas where its not allowed so sorry.
Yep, and unsilenced cars and bikes are not road legal, regardless of whether they're used for transport. Not even on Diwali. So do cars and bikes ...
Nope. I'm saying all people using a tradition or custom as an excuse to subject whole suburbs to pointless noise are ****wits. Even if they happen to be Hindus. Also, if they aren't.so are you saying all hindus are halfwits because of their cultural practice?
Wat?Dont pull figures from thin air.
So we get silent cars? So every car on the road is illegal?unsilenced cars and bikes are not road legal
So we get silent cars? So every car on the road is illegal?
