Well from that quote as well.. its sounds like a heavily modified car, so it wouldn't have been roadworthy according to the laws in this country...

@ saturnz - Can you confirm that all of your 5 cars are roadworthy/comply with all South African laws? Can you also confirm that you have fully disclosed the nature of your performance enhancements to your insurer?

Its not insured... and I'm guessing this might be the reason.

But now, legally, what happens to liability when one is willfully driving an non-roadworthy vehicle on public roads? Also, what about criminal charges?

It actually went through roadworthy as is in its current form (I had to do engine clearance and roadworthy to get the license disc) what would not make it roadworthy? All my cars are roadworthy, do you have solid proof its not roadworthy?

Roadworthy in it's current form? You took it for a roadworthy after the accident? Seems like a pretty suspicious thing to do IMO.

You have a heavily modified engine (as a guess from your own admission), that is generally grounds for the roadworthy status of a vehicle to be revoked.

When you did the engine clearance and all that did you disclose all modifications to the vehicle?

Still not sure why he doesn't just get the guys insurance details and do it through his insurance, in 90% of the cases it would be his responsibility to pay out Saturnz or his insurance as it was a rear collision, the only way it could be argued is if it's a hill or if there is a witness who will testify that Saturnz didn't indicate and swerved in front of him.
Not sure of the whole thread about it? It's not like it's the end of the world and there are processes and procedures to follow.

yes I'm following the process, first step is to get quotes of the damage, which I am in the process of doing. this thread is now just for our entertainment.

Well if the modifications were not disclosed, the engine clearance and roadworthy certificate were obtained fraudulently by yourself, and you were then willfully driving a vehicle that should not have been on the public roads. This changes certain aspects of things from a liability point of view, as well as from a criminal aspect point of view.
