Must be a slient partner only providing funds.
 
My take on this:

incubate, if you don't get this resolved to your satisfaction (ie the refund within a reasonable timeframe) go to the cops. Press charges of fraud, and tell them that he 'fled' to the USA from what you can see. If you are lucky to have his ID number or Company CC number (which I hope you do have), provide this info to the cops. They will be able to tag his passport, which means he'll be 'detained' as soon as he walks through customs at Jhb international.

Good luck with claims against "DOT Computers", because last time time I checked payment details on his site all deposits go directly into his personal account. I'm no expert, but surely a serious company that is a distributor for the likes of Alienware and OCZ should have a company bank account.

Yes, it does happen!!! Did it a few years ago after a pub brawl. Opened a case with the cops, the guy left SA. He came back 2 years later to visit his parents, and he got nabbed at Jhb International

Exactly my feeling when i joined. 1 or 2 mistakes is okay, but not 70% - 90% of orders.

Incubate, how did you know of Dot if it wasn't through the forums? What is his other "marketing channels"?
 
Its very difficult buying from an online shop because you cant see whats going on behind the website? I always phone the place, speak to the guy for a while ask a few questions, beleive me you can hear the difference between the hustle and busltle of a proffesional company and a kid sitting in his bedroom selling PC's!

I'm just saying from a legal point IF "DOT computers" had to say get into trouble for whatever reason and creditors and customers were to start claiming for whatever reason they would basically stand no chance of claiming from "DOT" seeing as how you are putting money into "Brians" personal account. I know they one and the same but .....

Am I correct ? Come where are the legal boffs ...

What is Dot Computers? A Pty, CC or is Person a sole trader. In any event AFAIK SARS has pretty wide powers to collect from CC members and company directors if they have been a bit ... er ... naughty. If he has been charging VAT and not doing his VAT returns he could be in a bit of the old brown stuff! LOL

Not a legal boff, but my understanding is that if Dotcomputers isn't a close corporation, partnership or PTY Ltd; then the owner is acting as a sole trader; and he is liable for all debts or claims arising against him or his trading business, since there is no distinction between the two, as opposed to a "limited liability" company.

Yes, if he is a registered company, sole proprietor ,cc or whatever, he would need the relevent bank account (definately not his personal one) to be audited. Which he is prob not doing. Unless he is doing this on a very small scale, he seems to think he's in the big time.
 
On that note, I can't find a registered company called DOT Information Technolgy
