One day i had to brake HARD [from 80km/h to practically < 10km/h] as a truck came on the other side, and 3 riders side-by-side, if i didn't brake i would have to either heads-on the truck, or killed a cyclist. After the truck passed and I could over take them, i angerly hooted at them [you know the one], and got variations of 'fck you' , 'wtf did we do' and 'piss off'.

This ^. Hooting at those ****ers is like hooting at a taxi driver. Will make ****all difference. Same *** mentality.

So is it legal for cyclists to use the M63 (Constantia Nek/Rhodes drive)? Regardless of the legality, it's got a lot of blind corners and uphill areas where cyclists have to move dangerously slowly and there is no shoulder for most of that route. Obviously it's popular for cycling but I'm wondering if it's legal for them to use it outside of cycling events.

So, you had to slow down and wait till it was safe to complete an overtaking manoeuvre like you were taught in your learners test? I don't see the problem, other than that the slow moving vehicle you wanted to overtake was bicycles?

Can I ask how much slowing down to overtake them cost you?

On any morning between 0500 and 0700 you will find cyclists on the same stretch of M4, despite this horrific incident and them being there also being against the law.
How long will it be till the next incident happens?

No, you have the complete wrong picture here

They weren't in the yellow line, it was 3 cyclist side-by-side, also , did you notice i had to brake HARD, i.e. very close to emergency stop. Also, what they we're doing is illegal as I pointed out with the law quotation.

I don't suppose the other 38 will be fined for cycling on a freeway.

often on my way home from morning star there are cyclist on the N7 - seems to be a new trend these days "fark authority" :wtf:

'He lied to me' - mother of Durban cyclist killed, after accused changes plea

Durban – "He cried on my shoulder. I told him I forgive him... But he lied to me."

This was the anguished reaction of Rosa Da Silva after she heard that the motorist accused of knocking down and killing her son Richard, 46, and his cycling partner Jared Dwyer, 36, was no longer pleading guilty to the crimes.

The incident occurred on the M4 highway leading out of the city in February last year and sparked a public outcry.

At his last court appearance in the Durban Regional Court earlier this month, Omesh Ramnarain, 33, indicated that he had concluded a plea bargain agreement with the State and would spend time in jail.

He said he ran his own business and needed time to sort out his affairs and the case was adjourned until Friday morning.

'Slapped in the face'

Expectation among Da Silva and Dwyer's family and friends was high. In terms of the plea bargain process, the victims' families are kept appraised of developments. They came for closure.

Instead, as one said, they were "slapped in the face".

Ramnarain's attorney Devin Moodley told Magistrate Anand Maharaj that he was withdrawing from the case "because of issues which arose during the finalisation of the plea agreement".

A new legal team, Reg Thomas and Advocate Murray Pitman, took over. They said they needed time to view the evidence and to assess whether to proceed with a plea agreement or go to trial.

Magistrate Maharaj put them on terms - to do so by October - and said either way, the matter would proceed in December.

"I am not saying you are playing games, but what if this happens again? This trial has already been stalled twice... The families came here with expectations. It is not fair to them," he said.

Outside of court, there was a heated scuffle as Ramnarain walked to the lifts during which he lost his shoe. A court orderly had to intervene.

Forgiveness

"You are a coward…You have no respect. If you are a man, then take what you deserve," a relative shouted at him.

Rosa Da Silva told News24: "I am not a woman with hate….but he lied to me."

She said at the last court appearance, Ramnarain had put his head on her shoulder and sobbed.

"He said my name.

"I have lost a child. But I accepted that he was just a child and I, as a mother, forgave him. He told me the whole story of what happened that day.

"Last night the family had dinner together and I told them we need to all forgive and let this go.

"I was going to visit him in jail to make sure he was well-treated, but he lied to me...he is just cruel and is playing with the devil."

Jarred Dwyer's mother Lee, was inconsolable.

She said she came from Cape Town for each court appearance.

"I will never ever forgive him now… He doesn't give a damn about anyone else… and the court has no respect for the families."

The matter was adjourned provisionally until October 6. The trial was set down again for December 4.

I feel sorry for the mother but the reality is that the forty lawbreakers cycling illegally on the freeway were the primary cause of the two deaths and the authorities don't care about that aspect.

Ramnarain to stand trial for cyclists' deaths

Motorist Omesh Ramnarain, who is accused of culpable homicide in connection with a crash in which two cyclists were killed, will stand trial early next year.

Ramnarain – who is facing two counts of culpable homicide in connection with the deaths of Richard da Silva, 46, and Jared Dwyer, 36, on the M4 last year – was expected to plead guilty last month.

This after lengthy negotiations between his then legal team and the State, which 
culminated in a plea agreement.

But at the last minute, Ramnarain changed his lawyers and they requested an adjournment to establish how they were going to proceed.

When he appeared in the Durban Regional Court on Friday, Ramnarain’s new advocate, Murray Pitman, said his client wanted to proceed to trial.

The trial was set down for a week in mid-January.

Was on the m4 on Sunday morning.Why are they cycling on a freeway :confused::wtf::twisted: Infact the whole on the north coast from Ballito down to durban north is full of them.They are a safety hazard to themselves and all road users.

Cycling is allowed on the M4 between uMhlangha and Ballito. It is the only route between those two places. The problem isn't the cyclists, its Sibaya. People go get drunk at the casino and drive home on the M4 as they know there are never cops on that road.
