Twins' murder accused case postponed for mental observation

Cape Town - The case of the Spanish national accused of murdering his twins in Hout Bay has been postponed to May because he is still waiting to undergo mental observation.

The Wynberg Magistrate's Court on Tuesday postponed Mario Yela's case to May 10 because of this.

The former dentist is accused of killing his 3-year-old twins, Maximo and Octavia, in a rented flat in Hout Bay on April 6.

His lawyer, William Booth, told the court at a previous appearance that he had suicidal tendencies. Booth deplored the conditions at Pollsmoor Prison, where Yela was waiting for his trial.

"There are rats, lice, cockroaches, and one shower and one toilet for 20 people. He has to sleep with dirty blankets on the floor," he said previously.

The court previously heard that Yela rented the holiday home for three weeks to visit the twins and his 7-year-old son.

He apparently sent a message to his former wife, Julia Engelhorn, asking her to come over for lunch. When she arrived, he told her he had killed the twins.

"She got up, went into the bedroom and discovered the twins. The third child was still at school. He had a knife in his possession. He then threatened to kill her," prosecutor Benito Adonis said at the time.

Engelhorn escaped and got help.

Thulsie twins' terror case delayed

Johannesburg - Clad in white Muslim headscarves, a backpack and winter jackets, the Thulsie twins walked into the Johannesburg Magistrate's Court yesterday looking calm and relaxed.

The brothers, Tony-Lee and Brandon-Lee Thulsie, whispered quietly to each other as court began, while their mother Wasiela broke into silent sobs, clutching a scarf tied around her neck.

According to their defence attorney, advocate Annelene van den Heever, this was their 23rd court appearance since their arrest in July last year on terrorism charges.

Discussions in court focused on centralising the Thulsie case as there are charges from various parts of South Africa, including the most recent charge of fraud for fake passports from Ficksburg in the Free State.

State prosecutor advocate Adele Barnard told the court the case could not be moved to the high court in Joburg until it was centralised and that they were waiting for the defence to give consent on the matter.

Terror-accused Thulsie twins' case postponed

Johannesburg – The case against the terror-accused Thulsie twins was postponed in the Johannesburg Magistrate's Court on Monday.

Brandon-Lee and Tony-Lee Thulsie, 23, appeared briefly in court on Monday. State prosecutor Advocate Adele Barnard told the court there was a lot of evidence, which included digital evidence against the accused.

Barnard said an analyst that was busy with the draft report was on leave. She asked for the matter to be postponed for two months.

"The State hasn't indicated when they started this process and how long they will take. The State cannot hold the investigation open indefinitely," their lawyer Ashraf Parak said.

Parak said earlier the State asked for a postponement of three months to request information from foreign agencies.

'Firearms, explosives, and possibly poison'


"Now the State comes and asked for a further two months. The accused have been in custody since July 2016, the investigations have been going on prior to their arrest, it has been going on for two years," he said.

The twins were arrested during raids in Newclare and Azaadville on the West Rand in July 2016.

According to the charge sheet, the brothers were allegedly linked to the self-proclaimed Islamic State (ISIS) group and were allegedly planning to detonate explosives at a US embassy and "Jewish institutions" in South Africa.

In the indictment submitted to the court in April, the State lists 12 activities the twins were instructed to carry out – using firearms, explosives, and possibly poison.

"In August 2015 [Tony-Lee] became a participant in a series of Telegram chats with Abu Fidaa, an ISIS network, and other persons whose real identities are unknown to the State, during which he was instructed to:

- Attack the best targets involving 'US/Brit/French interest in SA';
- Kill Zapiro, who drew the Messenger of Allah cartoon;
- Kill Jews who fight in Israel and return to South Africa;
- Kill affluent Jews; and
- Kill gay imam, "as yet unidentified".

Other targets included King David High School in Linksfield in Johannesburg, the UK High Commission, the embassies of the USA and Russia, the First Secretary to the French Mission, Jewish investment banker Roy Topol, SA Zionist Federation Telfed, state-owned arms manufacturer Denel, Jewish community events and foreign interests at airports.

'How to live a double life'

Tony-Lee is accused of discussing terrorist plans with an undercover US Federal Bureau of Investigation (FBI) agent between May and June 2016. He believed the agent was an ISIS operative based in the US. He allegedly sought advice on making bombs and asked for funding.

He is also accused of soliciting support for ISIS using his personal Facebook page.

Brandon-Lee allegedly acquired the Mujahideen Poisons Handbook by Abdek-Aziz, and the manual entitled How to Survive in the West: A Mujahid Guide, which teaches its readers how to "live a double life" and "how to keep your secret life private".

Earlier, the State said that the brothers collected issues of Inspire, the magazine of al-Qaeda in the Arabian Peninsula.

The issues contained an illustrated guide on making explosive devices, inciting participation in "jihad" and provided training in weapons and combat, the indictment said.

The defence also wanted to look at the docket to make a decision on centralising the fraud charge from Ficksburg in the Free State.

The matter was postponed to July 5 for further investigation.

Terror accused Thulsie twins to remain behind bars

Johannesburg - The terror case against twins Brandon-Lee and Tony-Lee Thulsie was on Wednesday again postponed in the Johannesburg Magistrate’s Court - this time because the defence needs digital records of the entire matter.

It has been a year since the twins were arrested on suspicion of plotting terror attacks in South Africa.

The twins, who have been behind bars since their arrest in July 2016, have been charged with conspiracy and incitement to commit the crime of terrorism and conspiring and attempting to commit acts associated with terrorist activities.

Prosecutor Adele Barnard told the court on Wednesday that 212 pages of statements previously requested by the defence had been handed to them. However, Barnard said "this morning" she received an email from the defence notifying her that they could not open the digital copies.

Brandon-Lee and Tony-Lee Thulsie, 23, both dressed in black, appeared briefly in court on Thursday morning, where they were served their indictments.

SA's Thulsie twins placed on US terror list

Johannesburg - The United States of America have frozen the assets and imposed other sanctions on South African terror-accused twins, Brandon-Lee and Tony-Lee Thulsie, for plotting a series of attacks on behalf of the Islamic State terrorist group against Jewish targets and the US Embassy, according to reports on Tuesday.

“Among other consequences, all of Tony-Lee Thulsie and Brandon-Lee Thulsie’s property and interests in property subject to US jurisdiction are blocked, and US persons are generally prohibited from engaging in any transactions with them,” the release stated according to news agency Sputnik.

The brothers were arrested in 2016, by South African authorities before the attacks were carried out, the release said.

Thulsie twins' lawyer set to challenge Terrorism Act

Johannesburg - Defence counsel for terror accused twins Brandon-Lee and Tony-Lee Thulsie on Friday told the Johannesburg High Court she intends to challenge the constitutionality of the Terrorism Act.

In pre-trial proceedings, Attorney Annelene van den Heever told Judge Raylene Keightley that she would be submitting a constitutional defence application, which would challenge the South African Terrorism Act, which her clients were being charged with.

"Prepare a pretrial draft with time lines," Judge Keightley ordered, adding that the issue would be dealt with at the accused's next appearance.

Van Den Heever said she will make other pre-trial applications, which include further disclosure, access to witnesses and physical evidence from the forensic laboratory.

Thulsie twins to spend another Christmas behind bars

Johannesburg - The Johannesburg High Court on Tuesday postponed pretrial proceedings of the terror accused twins Brandon-Lee and Tony-Lee Thulsie to next year to allow for arguments on the constitutionality of the Terrorism Act.

The twins have been in custody since they were arrested in July 2016 on suspicion of plotting terrorist attacks on various Jewish institutions in South Africa and individuals as well as attempting to join terror group ISIL. They were 23 years old when they were picked up by police.

Defence attorney Annelene van den Heever for the twins, told Judge Raylene Keightley that all parties had agreed on postponing the matter.

Keightley said that she would set aside Tuesday's arguments and ordered that the minister of police be present for the proceedings.

Asked if there was any movement on the declaration of the constitutionality of the Terrorism Act in another matter, state prosecutor, Chris MacAdam, said judgement had been reserved and might be handed down in February or March.
