Is this a valid traffic violation / charge?

Last time I tried something like that, the officer spelt my name, the street name, and the violation wrong - judge still told me to suck it up and gave me 50% off.

I'm guessing it will come down to that. Pity my sister her LLM degree is in Germany now.
 
im not sure about other places but the magistrate court in the area we used to stay had a traffic section. you go there fill in the form. they take the forms to the prosecutor and he decides the % off. usually got 50% the couple of occasions I went. much better than going to court I reckon.
 
So....Did she actually not stop at the stop sign/sing? If she didn't, she broke the law. Pay fine and be done with it.

My wife got this last Sunday, it reads "Disobey a stop sing"

Apart from the fact that the officer could not see the stop line where he was located half way down the bottom of a hill, and apart from the fact that he pulled her over on an unsafe road with a solid white line (forcing other cars into oncoming traffic) - is that a valid charge? "stop sing"?

I told her to go to court on the date at the bottom and just tell them she never disobeyed any "stop sing".

Read the summons and you'll see the spelling mistake doesn't make any difference.

You are called upon in terms of section 56 of the Criminal Procedure Act to appear before the court on the date of trial, both of which are mentioned herein below, at 08H45 and to remain in attendance there to answer a charge of contravening Sec 58(1) NRTA or such other charge(s) the prosecutor might bring in against you.

Even if 58(1) was wrong the prosecutor could still bring an alternative charge (ie the correct charge, on the day).

Most people misspell words because they are stupid, not because they are seeking attention. Case in point.

Anyway, we'll have to see how it goes when she goes to court. It would be great if they let her off because of the charge technicality, otherwise it's just one of those things.
 
I know what you can do, teach your wife to drive properly.

I don't drive, I ride. She should just pay more attention to what other drivers do on the road because all of them always stop at all stop sings and never drive faster than the speed limit.

Because it's totally ok to do something illegal when everyone else is doing it.

If she stopped when she saw the above, you wouldn't be having the problem.
 
People who habitually skip red lights/stop signs should just all kill themselves and get it over with. The world will be a better place.

Yes, unless you get caught as is the case here, then you need to try and get off the hook on a technicality or get the fine reduced.

It's going to be pretty hard at 20 km/h, even on my bicycle.
