Handling a weapon licenced to someone else is fine, provided it is done under their direct supervision and done in a place safe to do so.

Gazetted or just a sign put up? Big difference in legal consequences.

It's also a breach of the fca to not report someone else breaching the fca... I'm tempted to forward this video on and report him. You know just doing my civic duty and being a responsible upstanding citizen. :D

From what I remember, before the 2010 SWC all sport stadiums were made Gun Free zones by government. I think it was a requirement. I might be wrong though.

Yes, it is legislated under the Firearms Control Act, 2000; Firearms Control Regulations; Regulations 2004, 109) Firearm Free Zones.

However, it must be declared as such,

Firearm Free Zones

(1) The owner or the lawful occupier of premises or category of premises may submit a duly completed application form as prescribed in Annexure “A” together with any required supporting documents, to have the said premises declared a Firearm Free Zone.

(2) Such application must be submitted to the relevant Designated Firearms Officer and must be accompanied by a full motivation which shall include the following:

(a) Reason why the premises or category of premises must be declared as Firearm Free Zone;
(b) capacity to maintain the premises or category of premises as a Firearm Free Zone; and
(c) medium of communication to inform the public.

(3) The following specific conditions shall in all respects apply to Firearm Free Zones:

(a) the premises declared a Firearm Free Zone must be clearly identified and demarcated;
(b) notices must be posted at all the main entrances or at strategic places on the premises or category of premises in at least English and where applicable in the predominant local language promoting the premises or category of premises as Firearm Free Zones;
(c) the notices and signs must be clearly visible and unobscured at all
times;
(d) the institution where premises are declared Firearm Free Zone must endeavour to mark all correspondence accordingly to reflect the premises or category of premises as a Firearm Free Zone status; and
(e) the person applying on behalf of the Institution must notify the relevant Designated Firearms Officer of any changes that may occur to any information submitted in the application.

Yes, I believe all of our sport stadiums are declared a Gun Free Zone (GFZ). Anyhow, it is a civil offence to contravene the Gun Free Zone status of a premise. It is not a legal obligation other than enforced by declaration. Private guns are only prohibited by law as per the Control of Access to Public Premises and Vehicles Act which largely applies for government buildings (and, a-hem, courts :whistle:)

If it was the case of blanks being fired then they could have been upfront about it,

Police are to investigate an incident in which EFF leader Julius Malema was captured on camera seemingly discharging what appeared to be an automatic assault rifle at the Sisa Dukashe Stadium in Mdantsane, outside East London.

"I can confirm that the SAPS registered a case of discharging of a firearm in a built up area. The due processes will follow," said Brigadier Vish Naidoo.

Yes..it was a real firearm. Yes, it was live ammo.
No, there was no BFA attached to it, and the muzzle flash and sound makes that clear. Adriaan Snyman's company has 2 types of AR15...I suspect I know which one Malema took from one of the Specialized Security Services guards.
You can see Adriaan shat himself and so did the guard it was taken from. Of course the 6 brass empty cases will clearly show these were not blanks (which would have required an on-set armorer) but those 'doppies' are long gone by now.
The whole thing is a farce, and highly illegal. Not that it matters. Some people are allowed to do as they please.
 
Who cares if it was firing blanks or live ammo, or whether it was legal or not to discharge a firearm. The real issue is that a very popular political figure, one that has a seat in parliament and wields significant political influence, behaved like the militants we see discharging firearms across the world's various warzones and sh*tholes and he done so to cheers and applause. Its the mentality behind this that should be concerning you.

Johannesburg - With Afriforum laying criminal charges against Economic Freedom Fighters (EFF) leader Julius Malema over the rifle incident at his party's birthday bash in East London, the Black First Land First (BLF) now says it will open a case against "the white gunman" seen in viral video clip being handed back the weapon.

''The irresponsible behaviour of the white gunman was calculated to cause harm to black people. The crowd which was potentially under threat was black. The intention of the white man was very clear – that harm should come to black people,'' BLF said in a statement.
