Malema got a criminal record ?

According to some people on here and others I have spoken to, the case by Sonke against Malema was a civil case and so he does not have a criminal record even when found guilty.

I am now reading in Die Burger that according to a legal expert hate speech is indeed a crime and Malema will now have a criminal record.

Excerpt in Afrikaans:

Malema was nie by die hof nie. Sy prokureur, mnr. Tumi Mokwena, het aangedui Malema gaan aansoek om verlof tot appèl doen.

They are civil courts, the citation for the matter will be something along the lines of "Sisonke Gender Network v Malema" and not "S v Malema". If Malema was charged with crimen injuria, it would be a different matter.

Edit: Never trust a journalist who makes unequivocal statements about the law.

But a journalist did not make the statement it was made by a legal prof.
 
I doubt it. With all the case files getting lost it seems very difficult to get one.

Heard recently that za doesn't have specific hate speech legislation.
